ปัจจุบันประเทศไทยมีพันธกรณีในการเปิดเสรีการค้าบริการกิจการโทรทัศน์ภายใต้กรอบความตกลงทั่วไปว่าด้วยการค้าบริการ (General Agreement on Trade in Services: GATS) ซึ่งเป็นกรอบความตกลงหลักขององค์การการค้าโลก (World Trade Organizations: WTO) โดยประเทศไทยมีความผูกพันเปิดเสรีการค้าบริการกิจการโทรัทศน์ให้แก่ประเทศสมาชิก WTO อื่นๆ ใน 2 สาขา คือ บริการผลิตรายการโทรทัศน์ และบริการผลิตรายการโทรทัศน์แบบถ่ายทอดสดหรือบันทึกไว้ ซึ่งไม่รวมบริการส่งสัญญาณออกอากาศรายการโทรทัศน์ อย่างไรก็ดี ประเทศไทยยังไม่ได้เข้าผูกพันเปิดเสรีการค้าบริการกิจการโทรทัศน์อีก 2 สาขา คือ บริการทั้งผลิตและออกอากาศรายการ และบริการถ่ายทอดสัญญาณรายการโทรทัศน์ ประเทศไทยจึงยังไม่มีการเปิดเสรีการค้าบริการกิจการโทรทัศน์อย่างเต็มรูปแบบ แต่จากผลของการพัฒนาเทคโนโลยีทำให้กิจการโทรทัศน์ กิจการโทรคมนาคม และอินเตอร์เน็ต มีการหลอมรวมกันกลายเป็นปรากฎการณ์ที่เรียกว่า “การหลอมรวมเทคโนโลยี” (Technology Convergence) ปรากฎการณ์ดังกล่าวส่งผลให้โทรทัศน์กลายเป็นสื่อที่สามารถเข้าถึงได้จากทุกพื้นที่ทั่วโลก การปิดกั้นการให้บริการโทรทัศน์ข้ามพรมแดนจึงทำได้ลำบากมากขึ้น สิ่งเหล่านี้ล้วนเป็นแรงผลักดันให้ประเทศต่างๆ เตรียมความพร้อมเพื่อเปิดเสรีการค้าบริการกิจการโทรทัศน์ในระดับสูงขึ้น จนถึงการเปิดเสรีอย่างเต็มรูปแบบ เนื่องจากเทคโนโลยีมีผลให้การให้บริการโทรทัศน์ไม่อาจถูกจำกัดด้วยพรมแดนระหว่างประเทศอีกต่อไปเมื่อพิจารณาในบริบทการเตรียมความพร้อมของประเทศไทย พบว่ายังมีข้อจำกัดที่เป็นอุปสรรคต่อการเข้าสู่ตลาดการค้าบริการกิจการโทรทัศน์ทั้งในด้านนโยบายด้านความมั่นคงและวัฒนธรรมอันเป็นข้อจำกัดภายในประเทศ ความมาชัดเจนในการกำหนดคำนิยามหรือประเภทของการให้บริการโทรทัศน์ทางอินเตอร์เน็ตในเวทีการค้าโลกอันเป็นข้อจำกัดจากภายนอกประเทศ รวมถึงยังมีอุปสรรคจากบทบัญญัติแห่งกฎหมายและมาตรการกำกับดูแลภายในประเทศบางประการที่อาจส่งผลเป็นการกีดกันการเข้าสู่ตลาดของคนต่างด้าวหรือสร้างเงื่อนไขในการประกอบกิจการโทรทัศน์เกินสมควร นอกจากนั้น ยังพบว่าประเทศไทยไม่มีกฎหมายหรือมาตรการกำกับดูแลกิจการโทรทัศน์ทางอินเตอร์เน็ตอย่างเป็นรูปธรรม ตลอดจนมาตรการกำกับดูแลบางเรื่องยังไม่มีความชัดเจนในการรองรับการเปิดเสรีการค้าบริการกิจการโทรทัศน์
