๔ มาตรา ๑๕ ห้ามมิให้ผู้ใดประกอบธุรกิจโรงแรม เว้นแต่จะได้รับใบอนุญาตจากนายทะเบียน การขอใบอนุญาตและการออกใบอนุญาต ให้เป็นไปตามหลักเกณฑ์และวิธีการที่รัฐมนตรีประกาศกำหนด ๕ มาตรา ๕๙ ผู้ใดฝ่าฝืนมาตรา ๑๕ วรรคหนึ่ง ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองหมื่นบาท หรือทั้งจำทั้งปรับ และปรับอีกวันละไม่เกินหนึ่งหมื่นบาทตลอดเวลาที่ยังฝ่าฝืนอยู่ ๖ มาตรา ๖๓ ผู้ใดประกอบธุรกิจโรงแรมโดยไม่ได้รับใบอนุญาตอยู่ก่อนหรือในวันที่พระราชบัญญัตินี้ใช้บังคับ ถ้าประสงค์จะประกอบธุรกิจโรงแรมต่อไป ต้องยื่นคำขอรับใบอนุญาตต่อนายทะเบียนภายในหนึ่งปีนับแต่วันที่กฎกระทรวงซึ่งออกตามมาตรา ๑๓ ใช้บังคับ เมื่อได้ยื่นคำขอรับใบอนุญาตแล้วให้นายทะเบียนรับคำขอดังกล่าวเพื่อดำเนินการต่อไปตามพระราชบัญญัตินี้ และให้ผู้นั้นประกอบธุรกิจโรงแรมต่อไปได้จนกว่าจะได้รับแจ้งการไม่อนุญาตจากนายทะเบียน
