หลักเกณฑ์การจัดตั้งและดำเนินกิจการโรงเรียนนานาชาติ

เพื่อให้โรงเรียนนานาชาติมีคุณภาพและมีมาตรฐานที่สูงขึ้น กระทรวงศึกษาธิการจึงขอปรับปรุงหลักเกณฑ์การจัดตั้งและดำเนินกิจการโรงเรียนนานาชาติดังต่อไปนี้

1. คำจำกัดความ

โรงเรียนนานาชาติ หมายถึง สถานศึกษาที่จัดการศึกษาในระบบโดยใช้หลักสูตรต่างประเทศหรือหลักสูตรต่างประเทศที่ปรับรายละเอียดเนื้อหาวิชาใหม่หรือหลักสูตรที่จัดทำขึ้นเองที่ไม่ใช่หลักสูตรของกระ ทรวงศึกษาธิการและใช้ภาษาต่างประเทศเป็นสื่อในการเรียนการสอนให้กับนักเรียน โดยไม่จำกัด เชื้อชาติ ศาสนา และไม่ขัดต่อศีลธรรมความมั่นคงของประเทศ

2. คุณสมบัติของผู้ขอรับใบอนุญาตจัดตั้ง

ผู้ขอรับใบอนุญาตให้จัดตั้งโรงเรียนอาจเป็นบุคคลหรือนิติบุคคลที่มีคุณสมบัติดังนี้

2.1 บุคคลต้องมีสัญชาติไทยโดยการเกิดมีความรู้ไม่ต่ำกว่าปริญญาตรี และมีคุณสมบัติอื่นๆ ตามพระราชบัญญัติโรงเรียน เอกชน พ.ศ. 2525 และตามระเบียบที่กระทรวงศึกษาธิการกำหนด

2.2 นิติบุคคล

(1) มีวัตถุประสงค์เพื่อการศึกษา

(2) มีผู้ถือหุ้นหรือกรรมการที่มี สัญชาติไทยไม่น้อยกว่ากึ่งหนึ่ง

(3) ผู้ลงนามแทนนิติบุคคลที่เป็นผู้ขอรับใบอนุญาตให้จัดตั้งโรงเรียนต้องมีสัญชาติไทยโดยการเกิด

(4) มีคุณสมบัติอื่นตามพระราชบัญญัติโรงเรียนเอกชน พ.ศ. 2525 และระเบียบที่กระทรวง ศึกษา ธิการกำหนด

3. สถานที่ตั้ง

3.1 ที่ดิน ต้องมีลักษณะและขนาดเนื้อที่ที่เหมาะสมเพียงพอกับระดับการศึกษาที่ได้รับอนุญาติดังนี้

(1) ระดับก่อนประถมศึกษา ที่ดินต้องมีเนื้อที่ติดต่อเป็นผืนเดียวกันไม่น้อยกว่า 1 ไร่

(2) ระดับประถมศึกษา ที่ดินต้องมีเนื้อที่ติดต่อเป็นผืนเดียวกันไม่น้อยกว่า 2 ไร่

(3) ระดับมัธยมศึกษา ที่ดินต้องมีเนื้อที่ติดต่อเป็นผืนเดียวกันไม่น้อยกว่า 2 ไร่

(4) ถ้าเปิดสอนตั้งแต่ระดับก่อนประถมศึกษาถึงระดับมัธยมศึกษา ที่ดินต้องมีเนื้อที่ติดต่อเป็นผืนเดียวกันไม่น้อยกว่า 5 ไร่

3.2 ที่ดินที่ใช้จัดตั้งโรงเรียนต้องเป็นกรรมสิทธิ์ของผู้ขอรับใบอนุญาต หากที่ดินนั้นอยู่ในภาระการจำนอง ต้องเป็นการจำนองเพื่อการดำเนินงานตามโครงการเท่านั้น

3.3 ถ้าเป็นที่ดินเช่า ต้องมีลักษณะดังนี้

(1) เป็นที่ดินของสำนักงานทรัพย์สินส่วนพระมหากษัตริย์ ที่ราชพัสดุ ที่ศาสนสมบัติเป็นกลาง ที่ธรณีสงฆ์ หรือที่ขององค์การของรัฐ หรือรัฐวิสาหกิจ หรือ

(2) เป็นที่ดินของเอกชน แต่ต้องมีสัญญาเช่า ซึ่งมีระยะเวลาการเช่า แบ่งตามลำดับการศึกษา ดังนี้

- ระดับก่อนประถมศึกษา และหรือประถมศึกษา มีระยะเวลาการเช่าไม่น้อยกว่า 10 ปี

- ระดับมัธยมศึกษา มีระยะเวลาการเช่าไม่น้อยกว่า 15 ปี

3.4 ดินต้องตั้งอยู่ในสภาพแวดล้อมที่ดี การคมนาคมสะดวก มีรั้วรอบแสดงอาณาเขตที่แน่นอน มีขนาดกว้างขวางเพียงพอแก่กิจการของโรงเรียน ไม่เป็นที่น้ำท่วมขัง ไม่ขัดต่อสุขลักษณะและอนามัยของนักเรียน ไม่มีสถานประกอบการอื่นอยู่ภายในบริเวณหรืออยู่ใกล้โรงงานอุตสาหกรรม หรือสถานที่อันอาจก่อให้เกิดอันตรายใดๆ หรืออยู่ใกล้สถานที่อันอาจก่อให้เกิดอันตรายใดๆ หรืออยู่ใกล้สถานที่อันไม่เหมาะสมแก่กิจการ ยกเว้นหน่วยงานราชการที่รับผิดชอบรับรองความปลอดภัย

3.5 ต้องมีพื้นที่สีเขียวสำหรับนักเรียนไม่น้อยกว่า 1 ใน 3 ของพื้นที่ทั้งหมด

3.6 ต้องมีพื้นที่ในร่มหรือกลางแจ้งสำหรับกิจกรรมที่สนับสนุนการเรียนการสอนและนันทนาการของนักเรียน ไม่น้อยกว่า 1 ใน 3 ของเขตพื้นที่ใช้สอยทั้งหมด

4. อาคารและการออกแบบ

อาคารเรียนและอาคารประกอบต่าง ๆ ต้องมีความมั่นคงแข็งแรง มีแสงสว่างเพียงพอ อากาศถ่ายเทได้ดี ห้องเรียนต้องมีขนาดและลักษณะที่เหมาะสมเพียงพอกับหลักสูตรแต่ละระดับ โดยให้มีลักษณะ ดังนี้

4.1 ความสูงของอาคาร ระดับก่อนประถมศึกษาสูงได้ไม่เกิน 2 ชั้น และต้องไม้มีเสากลางห้อง ระดับประถมศึกษาและมัธยมศึกษา ถ้าอาคารสูงเกิน 4 ชั้น ต้องมีลิฟต์ความกว้างของทางขึ้นต้องไม่น้อยกว่า 1.50 เมตร

4.2 ขนาดของห้องเรียนไม่น้อยกว่า 48 ตารางเมตร ส่วนที่แคบสุดของห้องไม่น้อยกว่า 4 เมตร มีทางเข้าออก 2 ทาง แต่ละทางต้องกว้างไม่น้อยกว่า 80 เซนติเมตร ถ้ามีทางเข้าออกเพียงทางเดียวต้องกว้างไม่น้อยกว่า 1.60 เมตร

4.3 หลักเกณฑ์การคำนวนจำนวนนักเรียน

(1) ระดับก่อนประถมศึกษา ไม่เกิน 20 คนต่อห้อง หรือใช้หลักเกณฑ์คำนวน 2.5 ตารางเมตรต่อคน โดยอนุโลม

(2) ระดับประถมศึกษา ไม่เกิน 25 คนต่อห้อง หรือใช้หลักเกณฑ์คำนวน 2.0 ตารางเมตรต่อคน โดยอนุโลม

(3) ระดับมัธยมศึกษา ไม่เกิน 30 คนต่อห้อง หรือใช้หลักเกณฑ์คำนวน 1.50 ตารางเมตรต่อคน โดยอนุโลม และมีพื้นที่ว่างที่เหลือเพียงพอสำหรับการจัดกิจกรรม

4.4 จัดให้มีห้องน้ำ-ห้องส้วม แยกชาย-หญิง ไม่น้อยกว่าที่กำหนดในระเบียบ กระทรวงศึกษาธิการและเหมาะสมกับจำนวนนักเรียน

4.5 ต้องจัดให้มีห้องพยาบาลพร้อมเวชภัณฑ์ที่เหมาะสม ถ้าเปิดตั้งแต่ระดับประถมศึกษาขึ้นไปต้องแยกห้องพยาบาลชาย-หญิง

4.6 ห้องประกอบอย่างน้อยต้องประกอบด้วย ห้องธุรการ ห้องสมุด ห้องอาหาร ห้องภาษาไทยและศิลปวัฒนธรรม และห้องอื่น ๆ ตามความเหมาะสม พร้อมวัสดุคุรุภัณฑ์ที่จำเป็นแต่ละห้องอย่างเหมาะ สมและเพียงพอสำหรับการใช้ประโยชน์

5. หลักสูตร
