การตรารัฐธรรมนูญมาตรา 33 นี้ขึ้นมา ก็เพื่อให้ความคุ้มครองศักดิ์ศรีความเป็นมนุษย์และความเป็นผู้บริสุทธิ์ของประชาชนชาวไทยทุกคน ผลจากรัฐธรรมนูญมาตรานี้ทำให้ปัจจุบันนี้ ผู้ต้องหาหรือญาติของผู้ต้องหาสามารถฟ้องร้องฐานหมิ่นประมาทได้ (ตามประมวลกฎหมายอาญามาตรา 326 ว่าด้วยความผิดฐานหมิ่นประมาท) ดังนั้น ผู้สื่อข่าวจึงต้องระมัดระวังในการนำเสนอภาพและข่าว ตลอดจนข้อเขียนอื่น ๆ ต้องไม่เป็นการใส่ความทำให้ผู้อื่นเกิดความเสียหาย เสียชื่อเสียง เกียรติยศ โดยเฉพาะผู้สื่อข่าวสายอาชญากรรมหรือศาลซึ่งเกี่ยวข้องกับการทำข่าวด้านนี้โดยตรง
