กำหนดอัตราเงินสมทบกองทุนประกันสังคม
พ.ศ. 2556

อาศัยอำนาจตามความในมาตรา 7 วรรคหนึ่ง แห่งพระราชบัญญัติประกันสังคม พ.ศ.2533 และมาตรา 46 วรรคหนึ่งและสอง แห่งพระราชบัญญัติ พ.ศ. 2533 ซึ่งแก้ไขเพิ่มเติมโดยพระราชบัญญัติประกันสังคม (ฉบับที่ 3) พ.ศ. 2542 อันเป็นกฎหมายที่มีบทบัญญัติบา
ประการ เกี่ยวกับการจัดการสิทธิและเสรีภาพของบุคคล ซึ่งมาตรา 29 ประกอบกับมาตรา 33 มาตรา 41 และมาตรา 43 ของรัฐธรรมนูญแห่งราชอาณาจักรไทย บัญญัติให้กระทำได้โดยอาศัยอำนาจตามบทบัญญัติแห่งกฎหมาย รัฐมนตรีว่าการกระทรวงแรงงานออกกฎกระทรวงไว้ ดังต่อไปนี้

ข้อ 1 กฎกระทรวงนี้ให้บังคับใช้ตั้งแต่วันที่ 1 มกราคม พ.ศ.2556 เป็นต้นไป

ข้อ 2 ให้ยกเลิกกฎกระทรวงกำหนดอัตราเงินสมทบกองทุนประกันสังคม พ.ศ. 2555

ข้อ 3 ให้รัฐบาล นายจ้าง และผู้ประกันตนตามมาตรา 33 ออกเงินสมทบเข้ากองทุนเพื่อการจ่ายประโยชน์ทดแทนกรณีประสบอันตรายหรือเจ็บป่วย กรณีทุพพลภาพ กรณีตาย กรณีคลอดบุตร กรณีสงเคราะห์บุตร และกรณีชราภาพ ตามบัญชีอัตราเงินสมทบ ท้ายกระทรวงนี้ ดังต่อไปนี้

(1) ตั้งแต่วันที่ 1 มกราคม 2556 ถึงวันที่ 31 ธันวาคม 2556 ให้เป็นไปตามอัตราในบัญชี ก.

(2) ตั้งแต่วันที่ 1 มกราคม 2557 เป้นต้นไป ให้เป็นไปตามอัตราในบัญชี ข.
