สิ่งที่ไม่ชอบในประวัติศาสตร์กฎหมายไทยยุคกลางคือ ไม่มีความเป็นประชาธิปไตย อำนาจอยู่ที่พระมหากษัตริย์คนเดียว ทำให้เกิดความไม่เป็นธรรมในหลายๆอย่างเเละทำให้เกิดความห่างชั้นของคนในสังคม อีกทั้งรับวัฒนธรรมอินเดียมา ซึ่งทำให้เกิดการเเบ่งชนชั้นทางสังคมชัดเจน จึงเกิดความไม่เป็นธรรมสำหรับประชาชนทั่วไป
