มาตรา 61 บัญญัติว่า ถ้าจะเห็นได้การสิ้นสภาพบุคคลด้วยการเป็นบุคคลสาบสูญในกรณีธรรมดา ต้องหายไปจากภูมิลำเนาหรื่อถิ่นที่อยู่และไม่มีใครรู้แน่ว่าบุคคลนั้นยังมีชีวิตอยู่หรือไม่ตลอดระยะเวลา5ปี และมีกรณีพิเศษซึ่งจะลดระยะเวลาลงเหลือแค่2ปี ซึ่งในกรณีนี้บุคคลนั้นได้หายไปจากวันที่การลบหรือสงครามสิ้นสุดลง
