วิทยานิพนธ์ฉบับนี้ได้ศึกษาถึงปัญหาการจัดระบบกฎหมายที่กำหนดความผิดอาญาในประเทศไทย ซึ่งมีวัตถุประสงค์ที่จะทราบถึงแนวคิดและทฤษฎีที่เกี่ยวข้อง กฎหมายที่กำหนดความผิดอาญาทั้งในประเทศอังกฤษ ฝรั่งเศส และความเป็นมาของระบบกฎหมายที่กำหนดความผิดอาญาในประเทศไทยตั้งแต่อดีตจนถึงปัจจุบัน ทั้งนี้ก็เพื่อที่จะทราบถึงสภาพปัญหาและแนวทางการแก้ไขปัญหาที่จะพัฒนาให้ระบบกฎหมายที่กำหนดความผิดอาญาในประเทศไทยมีประสิทธิภาพ
