ใน พ.ศ. ๒๔๘๕ สภาผู้แทนราษฎรได้ตราพระราชบัญญัติราชบัณฑิตยสถาน พ.ศ. ๒๔๘๕ ขึ้นใช้แทนพระราชบัญญัติฉบับ พ.ศ. ๒๔๗๖ โดยกำหนดให้นายกรัฐมนตรีเป็นผู้เลือกราชบัณฑิตก่อนนำความกราบบังคมทูล และฐานะของราชบัณฑิตยสถานเปลี่ยนไปเป็นทบวงการเมือง อยู่ในบังคับบัญชาของนายกรัฐมนตรี

ต่อมามีการตราพระราชบัญญัติราชบัณฑิตยสถาน (ฉบับที่ ๒) พ.ศ. ๒๔๘๗ แก้ไขปรับปรุงพระราชบัญญัติฉบับ พ.ศ. ๒๔๘๕ ในบางมาตรา โดยให้ที่ประชุมราชบัณฑิตเป็นผู้เลือกภาคีสมาชิก แล้วเสนอนายกรัฐมนตรีนำควากราบบังคมทูลพระกรุณาทรงแต่งตั้งเป็นราชบัณฑิต และฐานะของราชบัณฑิตยสถานเปลี่ยนเป็นหน่วยงานอิสระขึ้นตรงต่อนายกรัฐมนตรี ตามมาตรา ๒๗ แห่งพระราชบัญญัติปรับปรุงกระทรวง ทบวง กรม (ฉบับที่ ๖) พุทธศักราช ๒๔๘๕
