ข้อกำหนดเกี่ยวกับหนังสือรับรองการจำหน่าย (Certificate of Free Sale)
1. หนังสือ CFS ต้องออกโดยประเทศผู้ผลิตหรือประเทศผู้จำหน่ายที่สำนักงานคณะกรรมการอาหารและยา รับรอง
หนังสือ CFS ที่ออกโดยประเทศผู้จำหน่ายที่สำนักงานคณะกรรมการอาหารและยารับรอง
ได้แก่ กรณีดังต่อไปนี้
1.1 ประเทศผู้จำหน่ายเป็นเจ้าของผลิตภัณฑ์ซึ่งได้ว่าจ้างให้ประเทศผู้ผลิตเป็นผู้ผลิตแทน
1.2 ประเทศผู้ผลิตไม่มีการจำหน่ายผลิตภัณฑ์ดังกล่าวเนื่องจากไม่มีกรณีที่จะต้องใช้ผลิตภัณฑ์ดังกล่าวหรือ
1.3 กรณีอื่น ๆ ตามที่ สำนักงานคณะกรรมการอาหารและยาเห็นสมควร
2. ในกรณีที่หนังสือ CFS ออกโดยประเทศผู้จำหน่าย ต้องแนบเอกสารเพิ่มเติม ดังนี้
2.1 หนังสือรับรองแหล่งผลิตจากประเทศผู้ผลิต
2.2 สำหรับผลิตภัณฑ์ยาและอาหารให้แนบเอกสาร ดังต่อไปนี้
2.2.1 หนังสือรับรองจากประเทศผู้ผลิต ที่ระบุข้อความรับรองคุณภาพแหล่งผลิตตามมาตรฐานสากล
2.2.2 หนังสือรับรองมาตรฐานผลิตภัณฑ์ว่ามีคุณภาพระดับเดียวกับผลิตภัณฑ์ที่จำหน่ายในประเทศผู้ออกหนังสือ CFS
3. หนังสือ CFS ตามข้อ 1 และหนังสือรับรองตามข้อ 2.2.1 ต้องออกหรือรับรองข้อความโดยหน่วยงานของรัฐ หรือสถาบันเอกชนที่รัฐรับรอง เช่น Notary Public, Chamber of Commerce
4. หนังสือ CFS ต้องระบุรายละเอียดต่อไปนี้
1.1 ชื่อผลิตภัณฑ์
1.2 ชื่อผู้ผลิต และสถานที่ตั้ง
1.3 ข้อความที่มีความหมายรับรองว่า “จำหน่ายได้ในประเทศผู้ออกหนังสือ”
1.4 ข้อความอื่น ๆ ตามที่แต่ละกองผลิตภัณฑ์กำหนดเช่น
- ผลิตภัณฑ์ยาให้ระบุส่วนประกอบตัวยาสำคัญและปริมาณด้วย
- เครื่องมือแพทย์ให้ระบุรุ่น (model) หรือ individual products ด้วย
5. หนังสือ CFS ต้องผ่านการรับรองจากหน่วยงานของกระทรวงการต่างประเทศของประเทศไทยหรือสำนักงานพาณิชย์ไทย
6. ข้อความในหนังสือ CFS ถ้าเป็นภาษาอื่น นอกจากภาษาอังกฤษให้แปลเป็นภาษาไทยหรือภาษาอังกฤษ โดยมีหน่วยงานที่เชื่อถือได้รับรอง
7. ในกรณีที่ใช้สำเนา CFS แทนฉบับจริง ต้องได้รับการรับรองข้อความจากหน่วยงานของรัฐหรือหน่วยงานเอกชน หรือบุคคลที่รัฐรับรอง
8. ในกรณีที่เป็นผลิตภัณฑ์หลายรายการแต่ใช้ CFS ฉบับเดียวกัน ต้องยื่น CFS ฉบับจริงพร้อมสำเนา ให้เจ้าหน้าที่ตรวจสอบการรับรองสำเนา
9. ให้ CFS มีอายุการใช้ภายในระยะเวลาที่กำหนดใน CFS นั้น และในกรณีที่มิได้ระบุอายุการใช้ ให้ยื่น CFS ภายในระยะเวลา 2 ปี นับแต่วันที่ออก CFS
