ไม่ว่าจะในยุคสมัยใด ในทุกๆสังคมรวมถึงสังคมไทยมีทั้งคนดีคนเลว และเชื่อแน่ว่าทุกๆคนย่อมปรารถนาที่จะอยู่ร่วมกันในสังคมให้ได้อย่างเป็นปกติสุข ดังนั้น ทุกๆสังคมจึงจำเป็นต้องกำหนดระเบียบกฎเกณฑ์ร่วมกันเพื่อควบคุมคนในสังคม ซึ่งกฎเกณฑ์ที่เป็นรูปธรรมที่สุดก็คือ กฎหมาย ทุกคนในสังคมต้องยึดถือและปฏิบัติตามกฎหมายอย่างเคร่งครัด หากผู้ใดละเมิดหรือฝ่าฝืน ย่อมถือได้ว่าผู้นั้นเป็นผู้ทำผิดกฎหมาย เรียกว่า นักโทษ การทำผิดและรูปแบบของกฎหมายมีหลากหลายประเภท แต่การทำผิดกฎหมายทางอาญา ที่เป็นการก่ออาชญากรรม หรือเรียกตัวผู้ก่อว่า อาชญากร นั้น ถือเป็นการทำผิดกฎหมายที่รุนแรง และเกิดประเด็นถกเถียงในเรื่องของการลงโทษอาชญากรตั้งแต่อดีตจนถึงปัจจุบัน

เรื่องของการก่ออาชญากรรมหรือก่อการฆาตรกรรมนั้น เป็นเรื่องที่ป้องกันและลดทอนให้น้อยลงได้ โดยการที่เริ่มต้นปลูกฝังประชากรตั้งแต่ยังเป็นเด็ก ส่งเสริมพัฒนาการทั้งด้านเชาว์ปัญญาและอารมณ์ให้ดำเนินควบคู่กันไป ไม่เน้นเรื่องใดเรื่องหนึ่งโดยเฉพาะ ซึ่งจะส่งผลให้เติบโตมาเป็นคนเก่ง คนดี และมีความสุข สังคมก็จะเจริญก้าวหน้า มีผู้กระทำความผิดน้อยหรือแทบจะไม่มีเลย แต่ทั้งนี้ทั้งนั้น หากเกิดการกระทำที่เป็นการทำให้ผู้อื่นถึงแก่ความตายขึ้นมาแล้ว การลงโทษด้วยการประหารชีวิต ก็สมควรจะเป็นบทลงโทษที่เหมาะสมที่สุด ด้วยเหตุผลหลักๆที่ว่า เป็นการแก้แค้นที่สมควรแล้ว เป็นตัวอย่างให้ผู้อื่นกลัวในการทำความผิด และเป็นการตัดโอกาสของบุคคลนั้นไม่ให้ไปกระทำความผิดซ้ำอีกนั้นเอง
