ความคิดทางด้านกฎหมายมหาชน ตามหลักกฎหมายสมัยใหม่ถือหลักว่าการปกครองและการ
บริหารราชการต้องเป็นไปโดยชอบด้วยกฎหมาย ที่เรียกว่า “Principle of Legality in
Administration” กล่าวคือ เจ้าพนักงานผู้ใช้อำนาจในการปกครองหรือบริหารบ้านเมืองจะ
ลิดรอนสิทธิ เสรีภาพ และทรัพย์สินของเอกชนได้ ก็เฉพาะแต่ที่กฎหมายให้อำนาจไว้โดย
ชัดแจ้งเท่านั้น และจะต้องกระทำด้วยกระบวนการขั้นตอนตามกฎหมายด้วย การปกครองใน
รัฐสมัยใหม่จึงจำต้องยอมรับหลักการแบ่งแยกอำนาจ (Separation of power) ออกเป็นอำนาจ
นิติบัญญัติ อำนาจบริหาร และอำนาจตุลาการ เพราะการแยกอำนาจดังกล่าวมิได้แบ่งเพื่อความ
เป็นระบบทางทฤษฎีเท่านั้น แต่แบ่งเพื่อให้เกิดผลประโยชน์ (for pragmatical purpose) เพื่อ
ประกันสิทธิเสรีภาพของประชาชนไม่ให้ตกอยู่ใต้อำนาจอำเภอใจของอำนาจฝ่ายใดฝ่ายหนึ่ง
