ในการขอทุเลาการบังคับคดีมีผลทำให้ทางบริษัท ยังไม่สามารถบังคับคดีตามคำพิพากษาได้ จะต้องรอฟังคำพิพากษาศาลอุทธรณ์เสียก่อน ซึ่งใช้เวลาตั้งแต่ 6 เดือน -2 ปี ซึ่งทางทนายจะต้องยื่นคำร้องคัดค้านการขอทุเลาการบังคับคดี เพื่อให้จำเลยวางหลักทรัพย์เป็นประกันเท่ากับยอดเงินตามคำพิพากษาของศาลชั้นต้น และศาลจะนัดไต่สวนคำร้องขอทุเลาการบังคับคดีในลำดับต่อไป
