เมื่อผู้บังคับบัญชาแต่ละชั้นได้พิจารณาคำร้องทุกข์ ดำเนินการแก้ไขหรือยุติเหตุการณ์ที่เกิดการร้องทุกข์ และแจ้งให้ลูกจ้างผู้ยื่นคำร้องทุกข์ทราบ หากลูกจ้างผู้ยื่นคำร้องทุกข์พอใจก็ให้แจ้งให้ผู้ยังคับบัญชาทราบโดยเร็วแต่ถ้าลูกจ้างผู้ยื่นคำร้องทุกข์ไม่พอใจ ก็ให้ยื่นอุทธรณ์ โดยกรอกข้อความที่อุทธรณ์ลงในแบบพิมพ์ที่นายจ้างได้กำหนดขึ้น หรือวิธีการอื่นใดที่นายจ้างกำหนดไว้และยื่นให้ผู้บังคับบัญชาสูงสุดภายใน 7 วัน นับแต่วันทราบผลการแก้ไขข้อร้องทุกข์จากผู้บังคับบัญชาระดับต้น
ผู้บังคับบัญชาสูงสุดจะพิจารณาอุทธรณ์และดำเนินการแก้ไขหรือยุติเหตุการณ์ตามคำร้องทุกข์ และแจ้งผลการดำเนินการให้ลูกจ้างผู้ยื่นคำร้องทุกข์ทราบภายใน 15 วัน
หากลูกจ้างผู้ยื่นคำร้องทุกข์ยังไม่พอใจผลการพิจารณาอุทธรณ์ของผู้บังคับบัญชาสูงสุด ย่อมมีสิทธิดำเนินการทางกฎหมายหรือเสนอต่อนายจ้างเพื่อร่วมกันตั้งผู้ชี้ขาดขึ้นเพื่อชี้ขาดปัญหาอันเกิดจากคำร้องทุกข์นั้นต่อไปได้
