หากคู่สัญญาฝ่ายใดฝ่ายหนึ่ง ผิดนัดผิ

หากคู่สัญญาฝ่ายใดฝ่ายหนึ่ง ผิดนัดผิดสัญญาข้อใดข้อหนึ่ง คู่สัญญาอีกฝ่ายหนึ่ง มีสิทธิบอกเลิกสัญญาได้ทันที และคู่สัญญาฝ่ายที่ผิดยินยอมชดใช้ค่าเสียหายพร้อมทั้งดอกเบี้ยในอัตราร้อยละ ต่อปี นับแต่วันบอกเลิกสัญญาเป็นต้นไป
