ในปี 2396 พระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัว รัชกาลที่ 4 ทรงพิจารณาเห็นว่าหมู่บ้านแฮ่ ซึ่งตั้งอยู่ริมห้วยน้ำหมานและอยู่ใกล้กับแม่น้ำเลย มีผู้คนเพิ่มมากขึ้น สมควรจะได้ตั้งเป็นเมืองเพื่อประโยชน์ในการปกครองอย่างใกล้ชิด จึงได้ทรงพระกรุณาโปรดเกล้าฯ ให้จัดตั้งเป็นเมือง เรียกชื่อตามนามของแม่น้ำเลยว่า "เมืองเลย"
ต่อมาในปี พ.ศ. 2440 ได้มีการประกาศใช้พระราชบัญญัติลักษณะการปกครองพื้นที่ ร.ศ.116 แบ่งการปกครองเมืองเลยออกเป็น 4 อำเภอ อำเภอที่ตั้งเมืองคือ อำเภอกุดป่อง ในปี พ.ศ.2442-2449 ได้เปลี่ยนชื่อเมืองเลยเป็นบริเวณลำน้ำเหือง และในปี 2450 ได้มีประกาศกระทรวงมหาดไทย ลงวันที่ 4 มกราคม พ.ศ.2450 ยกเลิกบริเวณลำน้ำเหืองให้คงเหลือไว้เฉพาะเมืองเลย โดยให้เปลี่ยนชื่ออำเภอกุดป่อง เป็น อำเภอเมืองเลย จนถึงปัจจุบัน
