หนังสือสัญญานายหน้า/Letter Commission

สัญญาฉบับนี้ทำขึ้นเมื่อวันที่.......4...........เดือน................กุมพาพันธ์......พ.ศ. ....2557.......................

กับ ข้าพเจ้า.......นางนราทิพย์ สายัญ.......อายุ......38....ปี อยู่ที่บ้านเลขที่........143.....หมู่......4........
ตำบล ..........หาดขาม.........อำเภอ....... กุยบุรี.......จังหวัด...ประจวบคีรีขันธ์.............ซึ่งต่อไปสัญญานี้เรียกว่า “นายหน้า” อีกฝ่ายหนึ่ง
คู่สัญญาทั้งสองฝ่ายตกลงกันทำสัญญา มีข้อความดังจะกล่าวต่อไปนี้

ข้อ 1. นายหน้า ตกลง จะทำหน้าที่เป็นนายหน้า ให้กับ ผู้ให้สัญญา ซึ่งเป็นเจ้าของ..............................
....... ห้องชุดเลขที่ 825/127 ชั้นที่ 17 อาคาร 1 ชื่อ อาคารชุด สปริงฟิลด์ บีช คอนโดมิเนียม ........................
โดยมีความประสงค์จะขายทรัพย์ดังกล่าว

ข้อ 2. นายหน้าตกลงจะเป็นผู้ติดต่อหาผู้ซื้อทรัพย์สินดังกล่าว ทั้งนี้เพื่อให้ผู้ให้สัญญาได้เข้าทำสัญญา กับผู้ซื้อจนเสร็จ

ข้อ 3. หากผู้ให้สัญญาสามารถขายทรัพย์ดังกล่าวข้างต้นได้ เนื่องจากผลแห่งการที่นายหน้าได้ชี้ช่องหรือจัดการให้ผู้ให้สัญญาได้ขายทรัพย์ ได้ในราคาไม่ต่ำกว่า....................................................บาท (...........................................................................) ผู้ให้สัญญาตกลงยินยอมจ่ายค่านานหน้าให้แก่นายหน้าในอัตรา......3.......เปอร์เซ็นต์ ของจำนวนเงินดังกล่าวโดยตกลงจะชำระเป็นงวด ๆ ดังนี้
ก.ในวันที่มีการทำสัญญาจะซื้อจะขาย จะจ่ายให้เป็นเงิน.............................-................................บาท

ข. ในวันที่ผู้ให้สัญญาได้รับเงินครบถ้วนจากผู้ซื้อ ส่วนที่ยังค้างอยู่ทั้งหมด
ค. ในกรณีที่มีการจดทะเบียนซื้อขายกัน และ ผู้ให้สัญญา ได้รับชำระเงินจากผู้ซื้อครบถ้วนผู้ให้สัญญา จะชำระค่านายหน้าทันที หรือ ภายในสองวัน ในกรณีที่ผู้ซื้อชำระเป็นแคชเชียร์เช็คหรือดร๊าฟ
ข้อ 4. ในกรณีที่ นายหน้า ได้ค่านายหน้า จากผู้ซื้อ ผู้ให้สัญญาไม่ต้องชำระค่านายหน้า
ข้อ 5. ในกรณีที่นายหน้าสามารถขายทรัพย์ได้เกินหรือสูงไปกว่าที่ตกลงในสัญญานี้ ผู้ให้สัญญาตกลงให้จำนวนเงินส่วนที่เกินเป็นของนายหน้า โดยนายหน้าจะเป็นผู้รับผิดชอบมีภาระเป็นผู้เสียภาษีอากรค่าธรรมเนียมการโอนกรรมสิทธิ์ และค่าธรรมเนียม ต่างๆ เกี่ยวกับการโอนเฉพาะส่วนที่เกินซึ่งนายหน้าเป็นผู้ได้รับเงิน

ข้อ 6. ผู้ให้สัญญาตกลงจะให้ค่าใช้จ่ายแก่นายหน้า เท่าที่จำเป็นสำหรับในกรณีที่หาผู้ซื้อมาทำสัญญาซื้อทรัพย์สำเร็จ เป็นเงินอีก.......................................บาท(.....................................................)

ข้อ 7. สัญญาฉบับนี้ให้มีผลบังคับใช้ตั้งแต่วันที่..............เดือน.....................................พ.ศ. ................
จนถึงวันที่............เดือน........................................พ.ศ. .................หากนายหน้ายังไม่สามารถหาผู้ซื้อ มาทำสัญญาซื้อขายได้สำเร็จ ให้ถือว่าสัญญานี้เป็นอันเลิกกันโดยไม่จำต้องบอกกล่าว

ข้อ 8. ในกรณีที่นายหน้าทำหน้าที่ผิดสัญญานายหน้า ทำให้ผู้ให้สัญญาเสียหายผู้ให้สัญญามีสิทธิบอกเลิกสัญญา และเรียกค่าเสียหายจากนายหน้าได้อีก

ข้อ 9. ในกรณีที่ผู้ให้สัญญาผิดสัญญาไม่ยอมขายทรัพย์ เมื่อนายหน้าได้ชี้ช่องและจัดการให้ได้เข้าทำสัญญาแล้ว ผู้ให้สัญญา ตกลงยอมชำระเงินให้กับนายหน้า ตามสัญญานี้เว้นแต่ในกรณี ทรัพย์ที่ขายถูกทางราชการเวณคืน หรือมีคำสั่งศาลห้ามจำหน่ายอันมิใช่เป็นความผิดของผู้ให้สัญญา
สัญญานี้ทำขึ้นเป็น......2.......ฉบับ มีข้อความตรงกัน คู่สัญญาทั้งสองฝ่ายได้อ่านและเข้าใจดีตลอดแล้ว จึงลงลายมือชื่อไว้เป็นสำคัญต่อหน้าพยาน
