จากการประชุมอย่างเป็นทางการของผู้นารัฐบาลอาเซียน ครั้งที่ 6 เมื่อวันที่ 16 ธันวาคม 2541 ณ กรุงฮานอย ประเทศเวียดนาม รัฐมนตรีเศรษฐกิจอาเซียนได้ร่วมลงนามในกรอบความตกลงอาเซียนว่าด้วยการอานวยความสะดวกในการขนส่งสินค้าผ่านแดน และที่ประชุมสุดยอดผู้นาอาเซียนได้เห็นชอบกับแผนปฏิบัติการฮานอย (Hanoi Plan of Action) ซึ่งกาหนดให้ประเทศสมาชิกเริ่มดาเนินการตามกรอบความ ตกลงอาเซียนว่าด้วยการอานวยความสะดวกในการขนส่งสินค้าผ่านแดน ภายในปี พ.ศ. 2543 โดยมีวัตถุประสงค์เพื่ออานวยความสะดวกในการขนส่งสินค้าผ่านแดนระหว่างประเทศสมาชิกอาเซียนให้มีระบบการขนส่งผ่านแดนที่มีประสิทธิภาพเพื่อสนับสนุนการจัดตั้งเขตการค้าเสรีอาเซียน โดยกรอบความตกลงนี้มีผลใช้บังคับแล้ว เมื่อวันที่ 2 ตุลาคม 2543 ซึ่งประเทศสมาชิกอาเซียนได้จัดส่งสัตยาบันสารให้เลขาธิการอาเซียนครบทั้ง 10 ประเทศแล้ว แต่อย่างไรก็ตามการดาเนินการตามกรอบความตกลงฯ ยังไม่สามารถเริ่มได้ เนื่องจากมีพิธีสารฯ บางฉบับที่ยังไม่สามารถสรุปประเด็นให้เห็นพ้องกันได้ จานวน ๒ ฉบับ ได้แก่ พิธีสาร ๒ การกาหนดที่ทาการด่านพรมแดน และพิธีสาร ๗ ระบบศุลการกรผ่านแดน จากจานวนพิธีสารฯ ทั้งหมด 9 ฉบับ

ข้อคิดเห็น/ข้อเสนอแนะ
๑. ความตกลงว่าด้วยการขนส่งสินค้าข้ามแดนไทย-มาเลเซีย กระทรวงคมนาคมอยู่ระหว่างร่วมยกร่างกรอบการเจรจากับมาเลเซียเพื่อน้าเสนอคณะรัฐมนตรีและเสนอต่อรัฐสภา ทั้งนี้ หากมีผลบังคับใช้จะช่วยแก้ไขปัญหาความไม่สะดวกในการผ่านแดนทั้งหมด รวมทั้งปัญหาการให้บริการรถโดยสารผ่านแดนและความไม่สมดุลในการให้ความอะลุ้มอล่วยในการให้รถเดินทางข้ามแดนที่ไทยให้มาเลเซียและที่มาเลเซียให้ไทยได้ ดังนั้น ภาครัฐควรเร่งด้าเนินการแก้ไขปัญหา โดยเฉพาะการน้าประเด็นเข้าหารือผ่านกรอบการเจรจาทั้งในระดับทวิภาคี และกรอบความร่วมมือต่างๆ เช่น ASEAN และ IMT-GT เป็นต้น
๒. ภายใต้กรอบเจรจาของ ASEAN โดยภาครัฐ ควรเจรจาเร่งรัดให้มาเลเซียให้สัตยาบันใน ASEAN Framework Agreement on Multimodal Transport เพื่ลดความเสียเปรียบในการขนส่งสินค้าผ่านแดน เนื่องจากไทยได้ให้สัตยาบันดังกล่าวแล้ว และออกพระราชบัญญัติการขนส่งสินค้าหลายรูปแบบ พ.ศ. ๒๕๔๘ ซึ่งเป็นผลให้มาเลเซียสามารถขนส่งสินค้าผ่านแดนไทยได้ทุกชนิดโดยไม่จ้ากัดปริมาณ และหากมาเลเซียยังไม่ให้สัตยาบัน ไทยก็ไม่สามารถขยายปริมาณการขนส่งสินค้าผ่านแดนมาเลเซียไปยังสิงคโปร์ได้
๓. ควรมีการเตรียมความพร้อมในทุกด้านเพื่อรองรับกฎ ระเบียบ และข้อบังคับที่จะต้องปฏิบัติร่วมกันภายใต้ความตกลงฯ ต่างๆ เช่น บูรณาการกฏหมายของหน่วยงานต่างๆ ให้เสริมสร้างความได้เปรียบแก่ประเทศ และสอดคล้องกับความตกลงฯ ต่างๆ ที่จะเกิดขึ้นในอนาคตต่อไปได้
