มาตรา ๓๙ ผู้จัดการอาจปฏิเสธไม่รับบุ

มาตรา ๓๙ ผู้จัดการอาจปฏิเสธไม่รับบุคคลที่ประสงค์จะเข้าพักในโรงแรมได้ในกรณี ดังต่อไปนี้
(๑) มีเหตุอันควรสงสัยได้ว่าบุคคลนั้นจะเข้าไปหลบซ่อน มั่วสุม หรือกระทำการใด อันเป็นความผิดอาญาขึ้นในโรงแรม หรือก่อให้เกิดความรำคาญแก่ผู้พักอื่นในโรงแรม
(๒) มีเหตุอันควรเชื่อได้ว่าบุคคลนั้นไม่สามารถจ่ายค่าห้องพักได้
(๓) มีเหตุอันควรเชื่อได้ว่าบุคคลนั้นเป็นโรคติดต่ออันตรายหรือโรคติดต่อตามกฎหมายว่าด้วยโรคติดต่อ
(๔) มีเหตุอันสมควรประการอื่นตามที่คณะกรรมการประกาศกำหนด
ในกรณีตาม (๓) ถ้าผู้จัดการรับบุคคลนั้นเข้าพักจะต้องแจ้งให้เจ้าพนักงานสาธารณสุขหรือพนักงานเจ้าหน้าที่ตามกฎหมายว่าด้วยโรคติดต่อทราบด้วย
