หากคู่สัญญาฝ่ายใดฝ่ายหนึ่งผิดนัดสัญ

หากคู่สัญญาฝ่ายใดฝ่ายหนึ่งผิดนัดสัญญาข้อใดข้อหนึ่ง ให้ถือว่า สัญญาเช่าเป็นอันสิ้นสุดลงโดยมิได้ ต้องบอกกล่าว และคู่สัญญาฝ่ายที่ผิดสัญญาต้องรับผิดชอบชดใช้ค่าเสียหายอันเกิดจากการผิดนัดสัญญานั้นด้วย ทั้งนี้ในกรณีที่ผู้ให้เช่าผิดสัญญาผู้เช่ามีอำนาจ ฟ้องร้องบังคับให้ผู้เช่าปฏิบัติตามสัญญาและเรียกร้องค่าเสียหายได้
