สารนิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาถึงแนวคิด ทฤษฎี ความเป็นมา และหลักการของการคุ้มครองสิทธิผู้ต้องขัง โดยศึกษาถึงการนำเรือนจำเอกชนมาใช้คุมขังผู้ต้องหาหรือจำเลยระหว่างพิจารณาของประเทศไทยและต่างประเทศ และทำการศึกษาถึงการดำเนินกิจการเรือนจำเอกชนในต่างประเทศเพื่อนำมาปรับใช้ในประเทศไทย รวมถึงวิเคราะห์และเสนอแนวทางแก้ไขในการปรับปรุงกฎหมายเกี่ยวกับการนำเรือนจำเอกชนมาใช้คุมขังผู้ต้องหาหรือจำเลยในระหว่างพิจารณาของประเทศไทย ให้เหมาะสมและสอดคล้องกับสภาพการณ์ปัจจุบันต่อไป
การวิจัยนี้เป็นการศึกษาวิจัยเชิงคุณภาพ แบบวิจัยเอกสาร (documentary research) รวบรวมเอกสาร กฎหมายต่างๆ เป็นสำคัญ หรือเป็นส่วนหลักของการวิจัยนี้ โดยดำเนินการศึกษาค้นคว้าเอกสาร บทความ งานวิจัย วิทยานิพนธ์ ตลอดจนตำราวิชาการต่างๆ ในทางกฎหมายที่เกี่ยวข้องกับการวิจัย ทั้งในส่วนของในประเทศและต่างประเทศที่ได้เคยศึกษามาก่อนแล้ว
จากการศึกษาพบว่า ควรนำเรือนจำเอกชนมาใช้เป็นสถานที่ที่ใช้คุมขังผู้ต้องหาหรือจำเลยในระหว่างพิจารณาคดี ซึ่งถือเป็นทางเลือกที่เหมาะสมในการแยกการคุมขังผู้ต้องหาหรือจำเลยในระหว่างพิจารณาคดีออกจากนักโทษเด็ดขาด ทั้งนี้เพื่อเป็นการเป็นการคุ้มครองสิทธิและเสรีภาพของผู้ต้องหาหรือจำเลยในระหว่างพิจารณาคดีตามที่บัญญัติรับรองไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทยพุทธศักราช 2550 และสอดคล้องกับกฎมาตรฐานขั้นต่ำของการปฏิบัติต่อนักโทษ และทำให้ไม่มีการถ่ายทอดพฤติกรรมอาชญากรรมจากนักโทษเด็ดขาดไปสู่ผู้ต้องหาหรือจำเลยในระหว่างพิจารณาคดี รวมทั้งยังแก้ปัญหาผู้ต้องขังล้นเรือนจำได้อีกด้วย
