เป็นรัฐธรรมนูญแห่งราชอาณาจักรไทย ฉบับที่ 19 จัดร่างโดยคณะรักษาความสงบแห่งชาติ คณะผู้ยึดอำนาจการปกครองหลังรัฐประหาร เมื่อวันที่ 22 พฤษภาคม 2557 ซึ่งมีพลเอก ประยุทธ์ จันทร์โอชา เป็นหัวหน้า ประกาศในราชกิจจานุเบกษา เล่ม 131 ตอนที่ 55 ก ณ วันที่ 22 กรกฎาคม 2557 มี 48 มาตรา โดยหัวหน้าคณะรักษาความสงบแห่งชาติเป็นผู้รับสนองพระบรมราชโองการ

รัฐธรรมนูญฉบับนี้มีอาจารย์กฎหมายจากจุฬาลงกรณ์มหาวิทยาลัยเป็นผู้ร่าง[1] พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดชพระราชทานพระบรมราชานุญาตและลงพระปรมาภิไธยเมื่อวันที่ 22 กรกฎาคม 2557 รัฐธรรมนูญมีผลใช้บังคับในวันเดียวกันและแทนที่รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550

รัฐธรรมนูญชั่วคราวนี้เปิดทางให้สถาปนาสภานิติบัญญัติแห่งชาติเพื่อใช้อำนาจนิติบัญญัติ คณะรัฐมนตรีชั่วคราวเพื่อรับผิดชอบการบริหารราชการแผ่นดิน สภาปฏิรูปแห่งชาติเพื่อดำเนินการปฏิรูปประเทศอย่างกว้างขวางและอนุมัติร่างรัฐธรรมนูญฉบับใหม่ และกรรมาธิการร่างรัฐธรรมนูญเพื่อร่างรัฐธรรมนูญฉบับใหม่ ทว่า รัฐธรรมนูญไม่ได้ระบุกรอบเวลาที่แน่นอนสำหรับงานเหล่านี้[2]

แม้รัฐธรรมนูญจะรับรองว่าประเทศไทยเป็นรัฐประชาธิปไตยและประชาชนเป็นองค์อธิปัตย์ แต่รัฐธรรมนูญนี้ก็นิรโทษกรรมสำหรับการกระทำทั้งสิ้นของทหารในอดีตและอนาคตเกี่ยวกับรัฐประหาร และให้ คสช. มีอำนาจล้นพ้นซึ่งสามารถออกคำสั่งใด ๆ เพื่อการปฏิรูปหรือความมั่นคง และคำสั่งเหล่านั้นถือว่าชอบด้วยกฎหมาย
