นายนาม ยิ้มแย้ม เกิดเมื่อวันที่ 1 เมษายน พ.ศ. 2479 ที่อำเภอพระประแดง จังหวัดสมุทรปราการ จบการศึกษาจากคณะนิติศาสตร์ มหาวิทยาลัยธรรมศาสตร์ และ เนติบัณฑิตไทย เป็นอดีตผู้พิพากษาหัวหน้าคณะในศาลฎีกา เป็นประธาน "คณะอนุกรรมการสืบสวนสอบสวนข้อเท็จจริงเพิ่มเติมสรุปกรณี นายสุเทพ เทือกสุบรรณ เลขาธิการพรรคประชาธิปัตย์ กล่าวหามีกระบวนการว่าจ้างพรรคการเมืองให้ลงสมัครรับเลือกตั้งสมาชิกสภาผู้แทนราษฎรเป็นการทั่วไปเมื่อวันที่ 2 เมษายน 2549" ซึ่งคณะอนุกรรมการนี้ดำเนินการสืบสวนตามมติของคณะกรรมการการเลือกตั้ง (กกต.) เมื่อวันที่ 20 เมษายน พ.ศ. 2549 ซึ่งผลการสืบสวนของคณะอนุกรรมการชุดนี้ มีมติให้ยุบพรรคไทยรักไทยและให้ดำเนินคดีตามกฎหมายกับคณะกรรมการบริหารพรรคด้วย
นายนาม ยิ้มแย้ม เข้ามาทำงานกับคณะกรรมการการเลือกตั้ง ฝ่ายสืบสวนสอบสวน ในคณะของนายสวัสดิ์ โชติพานิช อดีตประธานศาลฎีกา และกรรมการการเลือกตั้ง ฝ่ายสืบสวนสอบสวน ชุดที่ 1 เมื่อ พ.ศ. 2540
นายนาม ลงสมัครเป็นคณะกรรมการการเลือกตั้ง ชุดที่ 3 แต่ไม่ได้รับการคัดเลือกจากที่ประชุมวุฒิสภา ในวันที่ 8 กันยายน พ.ศ. 2549 ต่อมาภายหลังการรัฐประหารในประเทศไทย พ.ศ. 2549 ได้รับการทาบทามจากคณะปฏิรูปการปกครองในระบอบประชาธิปไตย อันมีพระมหากษัตริย์ทรงเป็นประมุข (คปค.) ให้ดำรงตำแหน่งคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ (ปปช.) แต่แล้วก็ไม่ได้รับการแต่งตั้ง โดยนายมีชัย ฤชุพันธุ์ ที่ปรึกษาฝ่ายกฎหมาย คปค.ให้เหตุผลว่า เนื่องจากนายนามมีอายุเกิน 70 ปี ซึ่งอาจเป็นข้อโต้แย้งถึงคุณสมบัติในการดำรงตำแหน่ง ปปช. ในภายหลังได้
นายนาม ยิ้มแย้ม ได้รับการแต่งตั้งเป็นคณะกรรมการตรวจสอบการกระทำที่ก่อให้เกิดความเสียหายแก่รัฐ คตส. ตามประกาศคณะปฏิรูปการปกครองในระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุข ฉบับที่ 30 เมื่อวันที่ 30 กันยายน พ.ศ. 2549 โดยทำหน้าที่เป็นประธาน
ในคดียุบพรรคไทยรักไทยและพรคประชาธิปัตย์ นายนามถูกกล่าวหาจากทางพรรคไทยรักไทยว่ามีความสนิทสนมกับนายชวน หลีกภัย อดีตหัวหน้าพรรคประชาธิปัตย์ แต่ทั้งนายนามและพรรคประชาธิปัตย์ ได้ออกมาปฏิเสธ อีกทั้งการพิจารณาของคณะตุลาการรัฐธรรมนูญก็มิได้เชื่อถือในกรณีนี้
