นายสมชัย สัจจพงษ์ อธิบดีกรมศุลกากร เปิดเผยว่า ขณะนี้กรมศุลกากรอยู่ระหว่างดำเนินการปฏิรูปประมวลกฎหมายศุลกากรทั้งฉบับ เพื่อเสนอรัฐบาลใหม่พิจารณาจะเกี่ยวข้องกับ 4 ประเด็นหลัก ได้แก่ 1. ข้อผูกพันที่ได้ตกลงกันในอาเซียน เพื่อรองรับการเปิดประชาคมอาเซียน (เออีซี) 2.การสร้างความโปร่งใสและความยืดหยุ่น ในการปฏิบัติพิธีการศุลกากร 3. การเพิ่มประสิทธิภาพของการปฏิบัติพิธีการศุลกากร และ 4.การเพิ่มขีดความสามารถในการแข่งขันของเอกชน ทั้งนี้การแก้ไขกฎหมายศุลกากรจะไม่กระทบรายได้ในการจัดเก็บรายได้ภาษีศุลกากร แต่จะมุ่งเน้นไปที่การเพิ่มความทัน สมัยมาตรฐานพิธีการศุลกากรให้เป็นสากล การเพิ่มความโปร่งใสอำนาจเจ้าพนักงาน

โดยเรื่องการลดอำนาจเจ้าพนักงานและเพิ่มความโปร่งใส จะมีการปรับหลักเกณฑ์ต่าง ได้แก่ 1.เงินสินบนรางวัลจะปรับหลักเกณฑ์ โดยกำหนดเพดานสินบน 30% ของมูลค่าอากร และกำหนดไม่เกิน 10 ล้านบาท ขณะที่เงินรางวัลปรับลดลงเหลือ 15% จากเดิม 25% ของมูลค่าอากร และกำหนดเพดานไม่เกิน 5 ล้านบาท

“เรื่องการให้สินบนรางวัลแก่ศุลกากรยังมีความจำเป็น แต่เจ้าหน้าที่ศุลกากรไม่ควรได้รับ ควรมอบเงินรางวัลดังกล่าวให้แก่คนข้างนอกที่เป็นสายที่แจ้งเบาะแส จึงได้กำหนดเพดานและปรับลดสัดส่วนเงินรางวัลแทน เพราะในอนาคตอัตราภาษีศุลกากรจะลดลง ทำให้ผู้ประกอบการไม่มีแรงจูงใจในการหนีภาษี แต่ต้องมีไว้เพื่อปราบปรามผู้กระทำ เช่นเดียวกันสหรัฐฯ อินโดนีเซีย อินเดีย บังกลาเทศ เป็นต้น”

2.ค่าปรับเงินเพิ่มจะเสนอ 2 แนวทางให้ฝ่ายนโยบายตัดสินใจ โดยพิจารณาจากเจตนาของผู้กระทำความผิดว่าจะปรับไม่เกิน 4 เท่า ของอากรหรือไม่ปรับเลย โดยให้อยู่ในดุลพินิจของศาล หรืออีกแนวทางหนึ่ง จะพิจารณาค่าปรับขั้นต่ำ 0.5 เท่า แต่ไม่เกิน 4 เท่าของอากร ตามข้อเสนอคณะกรรมการกฤษฎีกา 3.การสอบอากรย้อนหลัง กำลังดูว่า ควรจะกำหนด 5 ปีหรือ 7 ปีเพื่อป้องกันการโกงและลดภาระให้กับเอกชนในการเก็บเอกสาร โดยจะกำหนดให้เอกชนเก็บเอกสารเพื่อไว้ชี้แจงแค่ 5 ปีหรือ 7 ปี จากเดิม 10 ปี.
