ข้อ 2 วัตถุประสงค์แห่งสัญญา

ผู้จะขายมีความประสงค์จะขายห้องชุดและผู้จะซื้อมีความประสงค์จะซื้อห้องชุดตาม ข้อ 1

 

ข้อ 3 คำรับรองของผู้จะขาย

3.1 ผู้จะขายขอรับรองว่า ผู้จะขายเป็นเจ้าของกรรมสิทธิ์ห้องชุดที่ระบุไว้ใน ข้อ 1 โดยห้องชุดดังกล่าวได้ทำสัญญาจะซื้อจะขายกับทาง บริษัท อารียา พรอพเพอร์ตี้ จำกัด (มหาชน) เมื่อวันที่13 พฤษภาคม 2555 และผู้จะขายสามารถจะโอนกรรมสิทธิ์ห้องชุดดังกล่าวให้แก่ผู้จะซื้อได้ตลอดเวลาก่อนมีการจดทะเบียนโอนกรรมสิทธิ์กับ บริษัท อารียา พรอพเพอร์ตี้ จำกัด (มหาชน) และหลังจากชำระเงินใน ข้อ4 แล้ว

3.2 ผู้จะขายขอรับรองว่า ห้องชุดจะไม่ถูกโอนหรือเปลี่ยนชื่อเป็นผู้อื่น เว้นเสียแต่ผู้จะซื้อผิดสัญญาเท่านั้น

 

ข้อ 4 ราคาที่จะซื้อจะขาย

ผู้จะขายมีความประสงค์จะขายห้องชุดและผู้จะซื้อมีความประสงค์จะซื้อห้องชุดที่ระบุไว้ในข้อ 1 เป็นเงินทั้งสิ้น 1,245,000 บาท (หนึ่งล้านสองแสนสี่หมื่นห้าพันบาทถ้วน)

 

ข้อ 5 การชำระราคา

5.1 คู่สัญญาตกลงให้ถือเอาเงินมัดจำที่ผู้จะซื้อได้ชำระให้แก่ผู้จะขาย เมื่อวันที่2 พฤศจิกายน 2557 จำนวน 50,000 บาท (ห้าหมื่นบาทถ้วน) และเงินที่ผู้จะซื้อได้ชำระให้แก่ผู้จะขายในวันทำสัญญานี้ จำนวน 50,000 บาท (ห้าหมื่นบาทถ้วน) รวมเป็นค่าห้องชุด

5.3 ผู้จะซื้อตกลงจะชำระราคาค่าห้องชุดในส่วนที่เหลือให้แก่ผู้จะขายภายใน วันที่ 31 มีนาคม 2558 และก่อนวันจดทะเบียนโอนกรรมสิทธิ์ห้องชุด ตามรายละเอียดดังนี้

5.3.1 ชำระให้แก่ผู้จะขาย ในวันเปลี่ยนสัญญา จำนวน 367,200 บาท (สามแสนหกหมื่นเจ็ดพันสองร้อยบาทถ้วน)

5.3.2 ชำระให้แก่บริษัท อารียา พรอพเพอร์ตี้ จำกัด (มหาชน) เพื่อเปลี่ยนสัญญาจากชื่อของผู้จะขาย เป็น ชื่อของผู้จะซื้อ จำนวน 5,000 บาท (ห้าพันบาทถ้วน)

5.3.3 ชำระให้แก่บริษัท อารียา พรอพเพอร์ตี้ จำกัด (มหาชน) ในวันเปลี่ยนสัญญา จำนวน 787,800 บาท (เจ็ดแสนแปดหมื่นเจ็ดพันแปดร้อยบาทถ้วน)

5.4 ในการชำระราคาค่าห้องชุด เมื่อผู้จะซื้อชำระด้วยวิธีการโอนเงินให้แก่ผู้จะขาย ชื่อบัญชี นายสุเมธ เพ็ชรทอง ธนาคารกสิกรไทย จำกัด (มหาชน) สาขาแหลมฉบัง เลขที่บัญชี 3542564084 หรือชำระด้วยวิธีการอื่นให้ถือว่าสมบูรณ์ถูกต้อง
