หลักกระบวนยุติธรรมแทน กรณีตาม มาตรา 11 “ผู้ใดกระทำความผิดในราชอาณาจักร หรือกระทำความผิดที่ประมวลกฎหมายนี้ถือว่าได้กระทำในราชอาณาจักร ถ้าผู้นั้นได้รับโทษสำหรับการกระทำนั้นตามคำพิพากษาของศาลในต่างประเทศมาแล้วทั้งหมด หรือแต่บางส่วน ศาลจะลงโทษน้อยกว่า ที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้ หรือจะไม่ลงโทษเลยก็ได้ ทั้งนี้โดยคำนึงถึงโทษที่ผู้นั้นได้รับมาแล้ว
ในกรณีที่ผู้กระทำความผิดในราชอาณาจักร หรือกระทำความผิด ที่ประมวลกฎหมายนี้ถือว่าได้กระทำในราชอาณาจักร ได้ถูกฟ้องต่อศาลในต่างประเทศโดยรัฐบาลไทยร้องขอ ห้ามมิให้ลงโทษผู้นั้นใน ราชอาณาจักรเพราะการกระทำนั้นอีก ถ้า
(1) ได้มีคำพิพากษาของศาลในต่างประเทศอันถึงที่สุดให้ปล่อย ตัวผู้นั้นหรือ
(2) ศาลในต่างประเทศพิพากษาให้ลงโทษ และผู้นั้นได้พ้นโทษแล้ว”

1. กรณีที่ศาลไทยจะลงโทษอีกไม่ได้

1. กรณีที่ศาลไทยจะลงโทษอีกไม่ได้
1.1 ผู้กระทำผิดถูกฟ้องต่อศาลในต่างประเทศโดยรัฐบาลไทยร้องขอ และ
1.2 ศาลในต่างประเทศพิพากษาถึงที่สุดให้ปล่อยตัวผู้กระทำผิด หรือศาลในต่างประเทศพิพากษาให้ลงโทษและผู้นั้นได้พ้นโทษแล้ว
2. กรณีที่ศาลไทยมีดุลพินิจในการลงโทษ
2.1 ผู้กระทำผิดได้รับโทษตามคำพิพากษาของศาลในต่างประเทศมาแล้วทั้งหมด โดยที่รัฐบาลไทยมิได้เป็นผู้ร้องขอให้ลงโทษ หรือ
2.2 ผู้กระทำผิดได้รับโทษตามคำพิพากาของศาลในต่างประเทศมาแล้วบางส่วน
3. กรณีที่ศาลไทยต้องโทษโดยไม่มีดุลพินิจ
3.1 ศาลในต่างประเทศคำพิพากษาซึ่งยังไม่ถึงที่สุดให้ปล่อนตัวผู้นั้น หรือ
3.2 ศาลในต่างประเทศพิพากษาลงโทษ แต่ผู้นั้นไม่ได้รรับโทษเลย
3.3 ศาลในต่างประเทศมีคำพิพากษาถึงที่สุดให้ปลอ่ยตัวผู้นั้น โดยรัฐบาลไทยไม่ได้ร้องขอ
