มาตรา 123 ในกรณีที่นายจ้างฝ่าฝืนหรือไม่ปฏิบัติตามเกี่ยวกับสิทธิได้รับเงินอย่างหนึ่งอย่างใดตามพระราชบัญญัตินี้และลูกจ้างมีความประสงค์ให้พนักงานเจ้าหน้าที่ดำเนินการตามพระราชบัญญัตินี้ ให้ลูกจ้างมีสิทธิยื่นคำร้องต่อพนักงานตรวจแรงงานแห่งท้องที่ที่ลูกจ้างทำงานอยู่หรือที่นายจ้างมีภูมิลำเนาอยู่ตามแบบที่อธิบดีกำหนด
ในกรณีที่เกี่ยวกับสิทธิได้รับเงินอย่างหนึ่งอย่างใดตามพระราชบัญญัตินี้ ถ้าลูกจ้างถึงแก่ความตายให้ทายาทโดยธรรมมีสิทธิยื่นคำร้องต่อพนักงานตรวจแรงงานได้
