มาตรา ๓๔ เมื่อได้รับคำขอจดทะเบียนกา

มาตรา ๓๔ เมื่อได้รับคำขอจดทะเบียนการประกอบธุรกิจแฟรนไชส์ให้นายทะเบียนพิจารณาและตรวจสอบในเรื่องดังต่อไปนี้
(๑) ความถูกต้องครบถ้วนของคำขอจดทะเบียน รายการจดทะเบียนและเอกสารประกอบ
(๒) คุณสมบัติและไม่มีลักษณะต้องห้ามตามมาตรา ๓๓
(๓) สัญญาการประกอบธุรกิจแฟรนไชส์เป็นไปตามมาตรา ๒๓
(๔) การมีอยู่ของคู่มือการปฏิบัติงานตามมาตรา ๒๙
(๕) การมีอยู่ของแผนการดำเนินธุรกิจที่แฟรนไชส์ซอร์จะใช้ในการส่งเสริมและควบคุมการประกอบธุรกิจของแฟรนไชส์ซี
(๖) การประกอบธุรกิจที่จะนำมาเป็นแฟรนไชส์ของผู้ยื่นคำขอ
ในกรณีที่นายทะเบียนได้ตรวจสอบตามวรรคหนึ่งแล้วเห็นว่าถูกต้อง ให้นายทะเบียนรับจดทะเบียนการประกอบธุรกิจแฟรนไชส์และแจ้งเป็นหนังสือให้ผู้ ยื่นคำขอทราบภายในสิบห้าวันนับแต่วันที่ได้รับจดทะเบียนการประกอบธุรกิจแฟรน ไชส์
ในกรณีที่นายทะเบียนได้ตรวจสอบตามวรรคหนึ่งแล้วเห็นว่าไม่ถูกต้อง ให้นายทะเบียนมีคำสั่งให้ผู้ยื่นคำขอแก้ไขหรือเปลี่ยนแปลงสิ่งที่ไม่ถูกต้อง นั้นให้ถูกต้องภายในเวลาอันสมควร ทั้งนี้ไม่เกินหกสิบวันนับแต่วันที่นายทะเบียนมีคำสั่ง เมื่อผู้ยื่นคำขอได้แก้ไขหรือเปลี่ยนแปลงแล้ว ให้นายทะเบียนรับจดทะเบียนการประกอบธุรกิจแฟรนไชส์และแจ้งเป็นหนังสือให้ผู้ ยื่นคำขอทราบภายในสิบห้าวันนับแต่วันที่ได้รับจดทะเบียนการประกอบธุรกิจ แฟรนไชส์ดังกล่าว
ในกรณีที่ผู้ยื่นคำขอไม่ปฏิบัติตามคำสั่งที่ให้แก้ไขหรือเปลี่ยนแปลงภายใน เวลาที่กำหนด ให้นายทะเบียนมีคำสั่งไม่รับจดทะเบียนการประกอบธุรกิจแฟรนไชส์และให้นาย ทะเบียนแจ้งเป็นหนังสือพร้อมทั้งเหตุผลให้ผู้ยื่นคำขอทราบภายในสิบห้าวันนับ แต่วันสิ้นกำหนดเวลาให้ปฏิบัติตามคำสั่ง
ในการรับจดทะเบียนการประกอบธุรกิจแฟรนไชส์นายทะเบียนอาจกำหนดเงื่อนไขเพื่อ ให้ผู้ประกอบธุรกิจแฟรนไชส์ดำเนินการอย่างหนึ่งอย่างใดหรือหลายอย่างก็ได้
