โดยศาลพิเคราะห์แล้วเห็นว่า หมายที่ส่งไปทางไปรษณีย์ให้นายสุเทพ จำเลยที่ 2 ปรากฏว่าส่งไม่ได้ เนื่องจากไม่มีผู้มารับตามกำหนด จึงถือว่าจำเลยที่ 2 ไม่ทราบนัดโดยชอบตามกฎหมาย จึงนัดฟังคำสั่งศาลอุทธรณ์อีกครั้งวันที่ 17 กุมภาพันธ์ 2559 เวลา 09.00 น. พร้อมให้แจ้งวันนัดให้จำเลยที่ 2 ทราบ หากไม่มีผู้รับให้ปิดหมาย และกำชับให้จำเลยทั้งสองมาศาลหากไม่มาศาลจะสั่งตามที่เห็นสมควร
