มาตรา 4 “ผู้ใดกระทำความผิดในราชอาณาจักร ต้องรับโทษตามกฎหมาย”
ราชอาณาจักร หมายถึงดินแดนของประเทศไทย
1. พื้นดิน พื้นน้ำ ลำคลอง ที่อยู่ภายในเส้นเขตแดนของไทย รวมถึงเกาะด้วย
2. ทะเลอาณาเขต หมายถึง ท้องทะเลที่ติดกับเส้นเขตแดนของรัฐ วัดห่างออกไปจากฝั่ง 12 ไมล์ทะเล
3. พื้นอากาศที่อยู่เหนือ 1 และ 2
