14 พ.ค.58 พล.อ.เลิศรัตน์ รัตนวานิช ที่ปรึกษาและโฆษกคณะกรรมาธิการ (กมธ.) ยกร่างรัฐธรรมนูญ เปิดเผยถึงกรณีที่กมธ.ยกร่างรัฐธรรมนูญจะเชิญตัวแทนพรรคและนักการเมืองเข้าร่วมชี้แจงข้อเสนอของการแก้ไขเพิ่มเติมร่างรัฐธรรมนูญ ว่า ขณะนี้กมธ.ยกร่างรัฐธรรมนูญได้ส่งหนังสือไปยังพรรคการเมืองต่างๆ แล้วโดยเป็นพรรคการเมืองที่เคยมีส.ส.ปฏิบัติหน้าที่อยู่ในสภาผู้แทนราษฎร และได้กำหนดให้พรรคการเมืองส่งความเห็นกลับมายังกมธ.ยกร่างรัฐธรรมนูญ ภายในวันที่ 20 พ.ค.นี้ จากนั้นกมธ.ยกร่างรัฐธรรมนูญจะทำหนังสือเพื่อนัดหมายพรรคการเมืองที่ได้ทำความเห็นส่งกลับมายังกมธ.ยกร่างรัฐธรรมนูญอีกครั้งในวันที่ 6 มิ.ย. นี้ โดยจะนัดหมายเวลาเข้าชี้แจงไม่พร้อมกัน และจะเขียนเวลานัดหมายที่แน่นอนเพื่อไม่ให้ตัวแทนของพรรคการเมืองต้องรอการเข้าชี้แจงนาน

นพ.อำพล จินดาวัฒนะ สมาชิกสภาปฏิรูปแห่งชาติ (สปช.) เปิดเผยถึงการพิจารณาทำคำขอแก้ไขเพิ่มเติมร่างรัฐธรรมนูญ ว่า มี 3 ประเด็นสำคัญที่ตนได้เสนอและเบื้องต้นสปช.ในกลุ่มที่จะร่วมยื่นคำขอแก้ไขเพิ่มเติมร่างรัฐธรรมนูญได้เห็นร่วมกันที่จะส่งเรื่องไปยังคณะกรรมาธิการ (กมธ.) ยกร่างรัฐธรรมนูญแล้ว ได้แก่ 1.ประเด็นสมัชชาพลเมือง ที่กำหนดมาตรา 215 วรรคสาม ซึ่งตนมองว่าการกำหนดบทบัญญัติดังกล่าวและอยู่ในหมวด 7 ว่าด้วยการกระจายอำนาจและการบริหารท้องถิ่นไม่เหมาะสม และควรย้ายประเด็นสมัชชาพลเมืองไปอยู่ในส่วนของหมวดว่าด้วยพลเมือง เพื่อให้กระบวนการของสมัชชาพลเมืองนั้นอยู่ในทุกระดับของการพัฒนา ไม่เฉพาะแต่ประเด็นของการกระจายอำนาจหรือการบริหารท้องถิ่นเท่านั้น ทั้งนี้เพื่อให้กระบวนการมีส่วนร่วมของประชาชนตามระบอบประชาธิปไตยคือการมีส่วนร่วมจากประชาชนที่แท้จริงและในทุกระดับ ไม่ใช่ประชาธิปไตยแบบตัวแทนเหมือนที่ผ่านมา

2.บทบัญญัติว่าด้วยการให้มีคณะกรรมการดำเนินการแต่งตั้งข้าราชการโดยระบบคุณธรรม ในมาตรา 207 ทั้งนี้ตนเห็นด้วยที่จะให้การดำเนินการดังกล่าวด้วยระบบคุณธรรม แต่กรรมการที่จะเข้ามาทำหน้าที่แต่งตั้ง โยกย้ายข้าราชการระดับสูงควรมาจากภาคส่วนของสมัชชาคุณธรรมแห่งชาติและให้วุฒิสภาเป็นผู้คัดเลือกกรรมการฯ ไม่ใช่มาจากกรรมการที่เป็นผู้ดำรงตำแหน่งอยู่ในแวดวงราชการ เพราะจะทำให้ถูกมองว่ามีความเป็นราชการที่มีอำนาจเหนือตัวแทนประชาชนรวมถึงการยึดโยงกับบุคคล หรือ รัฐมนตรีที่มีความยึดโยงกับประชาชน

3.ประเด็นสภาขับเคลื่อนการปฏิรูปประเทศและคณะกรรมการยุทธศาสตร์การปฏิรูปแห่งชาติ ที่กำหนดไว้ในมาตรา 279 โดยตนเห็นว่าการขับเคลื่อนการปฏิรูปควรคงรูปแบบของคณะกรรมการฯ ไว้จะเหมาะสมกว่ารูปแบบของสภาขับเคลื่อนฯเพราะงานสานต่อการปฏิรูปต้องเน้นในประเด็นวิชาการ ดังนั้นรูปแบบของคณะกรรมการ คือ คงไว้เฉพาะคณะกรรมการยุทธศาสตร์การปฏิรูปแห่งชาติหรือกรรมการที่จะเกิดขึ้นจากการกำหนดการปฏิรูปด้านต่าง ๆ จะเหมาะสม ขณะที่ที่มาของสภาขับเคลื่อนการปฏิรูปประเทศและคณะกรรมการยุทธศาสตร์การปฏิรูปแห่งชาตินั้น ไม่ควรกำหนดให้มาจากสมาชิกสภานิติบัญญัติแห่งชาติ (สนช.),สปช. และผู้ทรงคุณวุฒิ ขณะที่อำนาจหน้าที่จะยังคงไว้ตามร่างรัฐธรรมนูญ
