2.9.9.1 ความมุ่งหมาย
1. เพื่อให้หน่วยที่เกี่ยวข้องทราบหน้าที่และวิธีปฏิบัติในการจัดซื้อยุทโธปกรณ์และการบริการทหารจากรัฐบาลต่างประเทศในระดับรัฐบาลต่อรัฐบาล
2. เพื่อให้การจัดซื้อวิธีนี้มีแนวปฏิบัติเดียวกันทั้ง ทบ.
3. เพื่อให้หน่วยสามารถออกคำสั่งการปฏิบัติภายในหน่วยได้ โดยไม่ขัดกับ รปจ.ฉบับนี้
2.9.9.2 คำกำจัดความ
1. การจัดซื้อยุทโธปกรณ์และการบริการทางทหารจากรัฐบาลต่างประเทศในระดับรัฐบาลต่อรัฐบาล ได้แก่การตกลงซื้อขายระหว่างรัฐบาลไทยกับรัฐบาลต่างประเทศโดยเหล่าทัพดำเนินการในนามของรัฐบาลไทยกับตัวแทนรัฐบาลต่างประเทศ ที่ได้รับการมอบหมายให้ดำเนินการในนามของรัฐบาลต่างประเทศนั้น ๆ
2. ข้อตกลงในการสั่งซื้อหรือจ้าง ได้แก่ข้อตกลงใจเงื่อนไขต่าง ๆ ในการจัดซื้อหรือจัดจ้าง ที่ทำขึ้นด้วยความเห็นชอบระหว่างผู้ซื้อและผู้ขายแทนการทำสัญญา
3. ผู้ลงนามในข้อตกลงผู้ซื้อหรือจ้างได้แก่หัวหน้าส่วนราชการที่คณะรัฐมนตรี มีมติให้เป็นผู้ลงนามในข้อตกลงในนามรัฐบาลไทยกับผู้แทนรัฐบาลผู้ขายหรือรับจ้าง
4. ผู้ลงนามในข้อตกลงฝ่ายผู้ขายหรือรับจ้างได้แก่บุคคลที่หน่วยงานรัฐบาลได้มีหนังสือมอบอำนาจให้hเป็นผู้มีอำนาจในการลงนามในข้อตกลงในนามรัฐบาลผู้ขายหรือผู้รับจ้างกับผู้แทนรัฐบาลไทย
5. หนังสือมอบอำนาจ ได้แก่ เอกสารที่หน่วยงานรัฐบาลของประเทศผู้ขายหรือผู้รับจ้าง แต่งตั้งให้บุคคลหนึ่งมีอำนาจในการเสนอราคา การเจรจาต่อรองราคาและเงื่อนไขต่าง ๆรวมถึงการลงนามในข้อตกลงในนามของรัฐบาลประเทศผู้ขายหรือรับจ้าง
6. คณะกรรมการเจรจาตกลงราคา ได้แก่คณะกรรมการที่หัวหน้าส่วนราชการที่รับผิดชอบในการจัดซื้อ/จัดจ้าง แต่งตั้งขึ้นจำนวนไม่น้อยกว่า 3 นาย เพื่อดำเนินการเจรจาตกลงราคาต่อรองราคาและเงื่อนไขที่ผู้ขายเสนอในกรณีที่มีการทดสอบสิ่งของที่จะจัดซื้อทั้งทางสนามและทางเทคนิค หัวหน้าส่วนราชการดังกล่าวก็สามารถแต่งตั้งคณะกรรมการขึ้นได้อีกตามที่เห็นสมควร
7. คณะกรรมการตรวจรับสิ่งอุปกรณ์ ได้แก่คณะกรรมการที่หัวหน้าส่วนราชการที่รับผิดชอบในการจัดซื้อ/จัดจ้าง แต่งตั้งขึ้นจำนวนไม่น้อยกว่า 3 นาย เพื่อทำการตรวจรับสิ่งอุปกรณ์จากการจัดซื้อ/จัดจ้าง2
8. วิธีการจัดซื้อ/จัดจ้างในระดับรัฐบาลต่อรัฐบาล เป็นการจัดซื้อวิธีหนึ่ง ซึ่งคณะรัฐมนตรีมีมติให้ดำเนินการได้โดยมิต้องปฏิบัติตามระเบียบสำนักนายกรัฐมนตรีว่าด้วยการพัสดุ โดยให้ยึดถือปฏิบัติตามหลักการจัดหายุทโธปกรณ์และบริการทางทหาร โดยวิธี FMS ซึ่งคณะปฏิวัติและคณะรัฐมนตรีมีมติอนุมัติไว้แล้ว
