รัฐธรรมนูญปัจจุบันซึ่งแก้ไขล่าสุดเมื่อวันที่ 1 มกราคม 2527 กำหนดให้สุลต่านทรงเป็นอธิปัตย์ คือ เป็นทั้งประมุขของประเทศ นายกรัฐมนตรี และรัฐมนตรีว่าการกระทรวงกลาโหม ทั้งนี้ นายกรัฐมนตรีจะต้องเป็นชาวบรูไนมีเชื้อสายมาเลย์โดยกำเนิด และจะต้องเป็นมุสลิมนิกายสุหนี่
