คสช." ออกคำสั่งที่ 32-33/2557 กำหนดหน้าที่ทหารตามกฎอัยการศึก 2457 ตั้งอธิบดีกรมสรรพากร-เลขาฯป.ป.ส.-เลขาฯ ปปง.- อธิบดีดีเอสไอ ตรวจสอบการเงินเพื่อความมั่นคง

เมื่อวันที่ 29 พ.ค. คณะรักษาความสงบแห่งชาติ (คสช.) ได้ออกแถลงการณ์คำสั่งคณะรักษาความสงบแห่งชาติ ที่ 32/2557 เรื่อง แต่งตั้งเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457

ตามที่ได้ประกาศใช้กฎอัยการศึกทั่วราชอาณาจักร ตั้งแต่วันที่ 22 พฤษภาคม พุทธศักราช 2557 เวลา 16.30 น. เป็นต้นไปแล้วนั้น เพื่อประโยชน์ในการปฏิบัติเกี่ยวกับการยุบ การระงับ การปราบปราม หรือการรักษาความสงบเรียบร้อย ตลอดจนการใช้อำนาจตามกฎอัยการศึก จึงให้ดำเนินการดังนี้

1. กำหนดเจ้าหน้าที่ฝ่ายทหาร ผู้ใช้อำนาจตามกฎอัยการศึกดังนี้
1.1 กองบัญชาการกองทัพไทย ผู้บัญชาการทหารสูงสุด เป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ทั่วราชอาณาจักร
1.2 กองทัพบก
1.2.1 ผู้บัญชาการทหารบกเป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ทั่วราชอาณาจักร
1.2.2 แม่ทัพภาค หรือผู้ที่ได้รับมอบหมายจากแม่ทัพภาค เป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ตามเขตกองทัพภาค
1.3 กองทัพเรือ
1.3.1 ผู้บัญชาการทหารเรือ เป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ในเขตรับผิดชอบของกองทัพเรือ
1.3.2 ผู้บัญชาการกองเรือยุทธการ หรือผู้ที่ได้รับมอบหมายจากผู้บัญชาการกองเรือยุทธการ เป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ในทะเลอาณาเขตที่รับผิดชอบ
1.3.3 ผู้บัญชาการกองเรือภาค หรือผู้ที่ได้รับมอบหมายจากผู้บัญชาการกองเรือภาค เป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ในเขตทะเล อาณาเขตที่รับผิดชอบ
1.4 กองทัพอากาศ ผู้บัญชาการทหารอากาศ หรือผู้ที่ได้รับมอบหมายจากผู้บัญชาการทหารอากาศ เป็นเจ้าหน้าที่ฝ่ายทหารตามกฎอัยการศึก พุทธศักราช 2457 ในเขตรับผิดชอบของกองทัพอากาศ

2. การใช้อำนาจของเจ้าหน้าที่ฝ่ายทหารตามคำสั่งนี้ หากเป็นการใช้อำนาจในการปฏิบัติการซ้อนกัน ให้ประสานกับปฏิบัติกับผู้รับผิดชอบพื้นที่ตามความจำเป็น

3. การใช้อำนาจตามกฎอัยการศึก พุทธศักราช 2457 ของเจ้าหน้าที่ฝ่ายทหาร เฉพาะการเกณฑ์ หากมีความจำเป็นต้องกระทำให้รายงานขออนุมัติต่อหัวหน้าคณะรักษาความสงบแห่งชาติก่อน เมื่อได้รับอนุมัติแล้วจึงจะดำเนินการได้ ทั้งนี้ ตั้งแต่วันที่ 22 พฤษภาคม 2557 เป็นต้นไป

ทั้งนี้ ยังได้แถลงการณ์คำสั่งคณะรักษาความสงบแห่งชาติ ที่ 33/2557 เรื่อง แต่งตั้งคณะทำงานเกี่ยวกับการตรวจสอบการทำธุรกรรมทางการเงิน หรือการดำเนินการเกี่ยวกับทรัพย์สินของบุคคล หรือนิติบุคคลเท่าที่จำเป็นแก่การรักษาความมั่นคงของชาติ และความปลอดภัยในชีวิตและทรัพย์สินของประชาชนโดยรวม

เพื่อเป็นการรักษาความสงบเรียบร้อย ความมั่นคงของชาติ และให้การดำเนินงานของคณะรักษาความสงบแห่งชาติเป็นไปอย่างมีประสิทธิภาพ จึงออกคำสั่งดังนี้

ข้อ 1 แต่งตั้งคณะทำงานในการปฏิบัติหน้าที่เกี่ยวกับการตรวจสอบการทำธุรกรรมทางการเงิน หรือการดำเนินการเกี่ยวกับทรัพย์สินของบุคคล หรือนิติบุคคลเท่าที่จำเป็นแก่การรักษาความมั่นคงของชาติ และความปลอดภัยในชีวิตและทรัพย์สินของประชาชนโดยรวม ดังนี้

1.1 อธิบดีกรมสรรพากร
1.2 เลขาธิการคณะกรรมการป้องกันและปราบปรามยาเสพติด
1.3 เลขาธิการคณะกรรมการป้องกันและปราบปรามการฟอกเงิน

ข้อ 2 ให้คณะทำงานตามข้อ 1 มีอำนาจแต่งตั้ง และมอบหมายเจ้าหน้าที่ผู้ใต้บังคับบัญชาเข้าร่วมปฏิบัติหน้าที่ได้ตามความเหมาะสม ทั้งนี้ ตั้งแต่บัดนี้เป็นต้นไป
