ประกาศกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม
เรื่อง กำหนดมาตรฐานควบคุมการปล่อยทิ้งอากาศเสียจากเตามูลฝอย
โดยที่เป็นการสมควรปรับปรุงการกำหนดมาตรฐานควบคุมการปล่อยทิ้งอากาศเสียจากเตาเผามูลฝอย อาศัยอำนาจตามความในมาตรา ๕๕ แห่งพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ.๒๕๓๕ อันเป็นพระราชบัญญัติที่มีบทบัญญัติบางประการเกี่ยวกับการจำกัดสิทธิและเสรีภาพของบุคคล ซึ่งมาตรา ๒๙ ประกอบกับมาตรา ๓๓ มาตรา ๓๘ มาตรา ๔๐ และมาตรา ๔๓ ของรัฐธรรมนูญแห่งราชอาณาจักรไทยบัญญัติให้กระทำได้โดยอาศัยอำนาจตามบทบัญญัติแห่งกฎหมาย รัฐมนตรีว่าการกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม โดยคำแนะนำของคณะกรรมการควบคุมมลพิษ และโดยความเห็นชอบของคณะกรรมการสิ่งแวดล้อมแห่งชาติ จึงออกประกาศไว้ ดังต่อไปนี้
ข้อ ๑ให้ยกเลิกประกาศกระทรวงวิทยาศาสตร์ เทคโนโลยีและสิ่งแวดล้อม เรื่อง กำหนดมาตรฐานควบคุมการปล่อยทิ้งอากาศเสียจากเตาเผามูลฝอย ลงวันที่ ๑๗ มิถุนายน พ.ศ. ๒๕๔๐
ข้อ ๒ ในประกาศนี้
“มูลฝอย” หมายความว่า เศษกระดาษ เศษผ้า เศษอาหาร เศษสินค้า เศษวัตถุ ถุงพลาสติก ภาชนะใส่อาหาร เถ้า มูลสัตว์ ซากสัตว์ หรือสิ่งอื่นใดที่เก็บกวาดจากถนน ตลาด ที่เลี้ยงสัตว์ หรือที่อื่น และหมายความรวมถึงมูลฝอยติดเชื้อ มูลฝอยที่เป็นพิษหรืออันตรายจากชุมชน
“เตาเผามูลฝอย” หมายความถึง
(๑) “เตาเผามูลฝอยเก่า” หมายความว่า เตาเผามูลฝอยที่ได้รับใบอนุญาตประกอบกิจการโรงงานหรือใบอนุญาตขยายโรงงานตามกฎหมายว่าด้วยโรงงาน หรือเตาเผามูลฝอยตามกฎหมายอื่นที่ได้รับอนุมัติให้ก่อสร้างไว้แล้วก่อนวันที่ประกาศนี้ประกาศในราชกิจจานุเบกษา หรือเตาเผามูลฝอย ที่ดำเนินการมาก่อนหรือในวันที่ประกาศนี้มีผลใช้บังคับ
(๒) “เคาเผามูลฝอยใหม่” หมายความว่า เตาเผามูลฝอยที่ได้รับใบอนุญาตประกอบกิจการโรงงานหรือใบอนุญาตขยายโรงงานตามกฎหมายว่าด้วยโรงงาน หรือเตาเผามูลฝอยตามกฎหมายอื่นที่ได้รับอนุมัติให้ก่อสร้างภายหลังวันที่ประกาศนี้ประกาศในราชกิจจานุเบกษา หรือเตาเผามูลฝอยที่ดำเนินการหลังจากวันที่ประกาศนี้มีผลใช้บังคับ
