โบราณวัตถุใดสามารถทำการค้าได้หรือไม

โบราณวัตถุใดสามารถทำการค้าได้หรือไม่มิได้ขึ้นอยู่กับว่าเป็นโบราณวัตถุที่ขึ้นทะเบียนแล้วหรือยังมิได้ขึ้นทะเบียน แต่ต้องพิจารณาว่าเป็นโบราณวัตถุที่สมควรสงวนไว้เป็นสมบัติของชาติหรือไม่ ซึ่งโบราณวัตถุใดที่อธิบดีกรมศิลปากรเห็นว่าเป็นโบราณวัตถุที่สมควรสงวนไว้เป็นสมบัติของชาติ อธิบดีก็มีอำนาจประกาศในราชกิจจานุเบกษากำหนดว่าโบราณวัตถุนั้นเป็น “โบราณวัตถุที่ห้ามทำการค้า” และมีอำนาจจัดซื้อโบราณวัตถุนั้นเพื่อสงวนไว้เป็นสมบัติของชาติต่อไป
บุคคลใดประสงค์จะค้าโบราณวัตถุที่มิใช่โบราณวัตถุที่ห้ามทำการค้า ต้องขอรับใบอนุญาตจากอธิบดีกรมศิลปากรก่อน ตามหลักเกณฑ์และวิธีการที่กำหนดไว้ในกฎกระทรวง ฉบับที่ ๔ (พ.ศ. ๒๕๓๙) ออกตามความในพระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ พ.ศ. ๒๕๐๔
เมื่ออธิบดีกรมศิลปากรอนุญาตแล้วจะประกาศรายชื่อผู้ได้รับอนุญาตให้ทำการค้าในราชกิจจานุเบกษา แต่กรณีที่อธิบดีไม่อนุญาต ผู้ขอรับใบอนุญาตมีสิทธิอุทธรณ์เป็นหนังสือต่อรัฐมนตรีภายในสามสิบวัน นับแต่วันที่ได้ทราบคำสั่ง คำวินิจฉัยของรัฐมนตรีให้ถือเป็นที่สุด
เมื่อได้รับใบอนุญาตให้ทำการค้าโบราณวัตถุแล้ว ผู้รับใบอนุญาตจะต้องแสดงใบอนุญาตค้าโบราณวัตถุไว้ในที่เปิดเผยและเห็นได้ง่าย ณ สถานที่ทำการค้า และต้องทำบัญชีรายการโบราณวัตถุที่อยู่ในความครอบครองและรักษาบัญชีไว้ ณ สถานที่ทำการค้าดังกล่าว
สำหรับการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรนั้น แยกได้สองลักษณะ ได้แก่ การส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการเด็ดขาด และการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการชั่วคราว ซึ่งมีหลักเกณฑ์
การส่งหรือนำออกนอกราชอาณาจักรแตกต่างกันออกไป โดยการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการเด็ดขาด กฎหมายห้ามมิให้ผู้ใดส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักร เว้นแต่จะได้รับอนุญาตจากอธิบดีกรมศิลปากร โดยต้องดำเนินการตามกฎกระทรวง ฉบับที่ ๕ (พ.ศ. ๒๕๓๙) ออกตามความในพระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ
พ.ศ. ๒๕๐๔ ซึ่งมีหลักสำคัญ คือ
๑. ผู้ที่ประสงค์จะส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักร
ต้องยื่นคำขอรับใบอนุญาตตามแบบ ศก. ๖ ท้ายกฎกระทรวงฯ
๒. ในการยื่นคำขอรับใบอนุญาตส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักร ผู้ขอรับใบอนุญาตต้องนำโบราณวัตถุที่จะส่งหรือนำออกนอกราชอาณาจักรนั้นมาแสดง ณ สถานที่ที่ยื่นคำขอรับใบอนุญาตเพื่อให้เจ้าหน้าที่ทำการตรวจพิสูจน์ด้วย หรือหากไม่สามารถนำโบราณวัตถุนั้นมาได้ผู้ขอรับใบอนุญาตต้องทำคำขอเป็นหนังสือพร้อมทั้งแสดงเหตุผลเสนอต่อผู้อนุญาตเพื่อให้มีการตรวจพิสูจน์โบราณวัตถุนั้น ณ สถานที่เก็บโบราณวัตถุ
๓. หากโบราณวัตถุที่ต้องการการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นพระพุทธรูปหรือรูปเคารพในศาสนา ผู้ขอรับใบอนุญาตต้องแจ้งวัตถุประสงค์ในการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรด้วย
๔. โบราณวัตถุที่ได้รับอนุญาตให้ส่งหรือนำออกนอกราชอาณาจักรจะต้องมีตราตะกั่วรูปพระคเณศพร้อมกับบัตรแสดงหมายเลขที่ใบอนุญาตตามที่
กรมศิลปากรกำหนดผูกหรือผนึกติดกับโบราณวัตถุนั้นทุกชิ้น
๕. ผู้รับใบอนุญาตส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรต้องเสียค่าธรรมเนียมตามที่กำหนดในกฎกระทรวง ฉบับที่ ๖ (พ.ศ. ๒๕๓๙) ออกตามความในพระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ พ.ศ. ๒๕๐๔
การส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการชั่วคราว
มีหลักการสำคัญคล้ายคลึงกับการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการเด็ดขาดตามที่กำหนดไว้ในกฎกระทรวง ฉบับที่ ๕ (พ.ศ. ๒๕๓๙) ออกตามความในพระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ
พ.ศ. ๒๕๐๔ เช่นเดียวกัน แต่แตกต่างกันตรงที่ต้องเพิ่มหลักประกันว่าจะมีการส่งโบราณวัตถุกลับมาในราชอาณาจักรตามที่กำหนดไว้ ซึ่งพอสรุปหลักการสำคัญในการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการชั่วคราวได้ ดังนี้
๑. ผู้ที่ประสงค์จะส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการชั่วคราว ต้องยื่นคำขอรับใบอนุญาตตามแบบ ศก. ๗ ท้ายกฎกระทรวงฯ

๓. หากโบราณวัตถุที่ต้องการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรเป็นการชั่วคราวนั้นเป็นพระพุทธรูปหรือรูปเคารพในศาสนา ผู้ขอรับใบอนุญาตต้องแจ้งวัตถุประสงค์ในการส่งหรือนำโบราณวัตถุออกนอกราชอาณาจักรด้วย
