สัญญานี้ทำขึ้นระหว่าง 1.)นายธารินทร์ นิมมานเหมินท์ ถือบัตรประจำตัวประชาชนเลขที่ 5 1014 00026 80 6 อายุ 70 ปี อยู่บ้านเลขที่ 26 ซอยสุขุมวิท 47 (บ้านดอน) แขวงคลองตันเหนือ เขตวัฒนา และ 2.)นายศิรินทร์ นิมมานเหมินท์ ถือบัตรประจำตัวประชาชนเลขที่ 3 5099 00991 94 0 อายุ 68 ปี อยู่บ้านเลขที่ 593 ซอยพหลโยธิน32 แขวงจันทรเกษม เขตจตุจักร กรุงเทพมหานคร ในฐานะผู้จัดการมรดกของนางจรรยา นิมมานเหมินท์ ตามคำสั่งศาลแพ่งกรุงเทพใต้ คดีหมายเลขดำที่ 3611/2549 คดีหมายเลขแดงที่ 5173/2549 เมื่อวันที่ 7 กรกฎาคม 2549 ซึ่งต่อไปในสัญญานี้เรียกว่า “ผู้ให้เช่า” ฝ่ายหนึ่ง
กับนายลอเร็นซ แปร์ภารี่ ถือบัตรประจำตัวประชาชนเลขที่ 3 5001 00418 02 3 สัญชาติออสเตรีย อายุ 81 ปี อยู่บ้านเลขที่ 126/1 หมู่ที่ 7 ตำบลฟ้าฮ่าม อำเภอเมืองเชียงใหม่ จังหวัดเชียงใหม่ ซึ่งต่อไปในสัญญานี้เรียกว่า “ผู้เช่า” อีกฝ่ายหนึ่ง
คู่สัญญาทั้งสองฝ่ายตกลงทำสัญญากันดังมีข้อความต่อไปนี้
ข้อ1. ทรัพย์ที่เช่า
ผู้ให้เช่าตกลงให้เช่าและผู้เช่าตกลงเช่าที่ดินหนังสือรับรองการทำประโยชน์ สารบบหมู่ที่ 1 เลขที่ 486/208 เล่มที่ 18(2) หน้า 784 ตำบลฟ้าฮ่าม อำเภอเมืองเชียงใหม่ จังหวัดเชียงใหม่ เนื้อที่ดิน1งาน 85ตารางวา ปรากฏตามแผนผังแนบท้ายสัญญานี้ และให้ถือเป็นส่วนหนึ่งของสัญญาเช่านี้ด้วยต่อไปในสัญญานี้จะเรียกว่า “ สถานที่เช่า ” โดยผู้เช่าตกลงยอมรับว่าที่ดินดังกล่าวเป็นกรรมสิทธิ์ของผู้ให้เช่าทั้งสองถูกต้องตามกฎหมายแต่เพียงฝ่ายเดียว
ข้อ 2. อัตราค่าเช่าและระยะเวลาเช่า
ผู้เช่าตกลงเช่าทรัพย์ตามข้อ 1. ตำบลฟ้าฮ่าม อำเภอเมืองเชียงใหม่ จังหวัดเชียงใหม่ มีกำหนดระยะเวลา….…………ปี นับตั้งแต่วันที่…………เดือน…………………………พ.ศ.……………..ถึงวันที่…………..เดือน………………………………พ.ศ. …………….………….ในอัตราค่าเช่าเดือนละ…………………………………….บาท (……………………………………………)โดยผู้เช่าจะชำระค่าเช่าล่วงหน้าให้ผู้ให้เช่าเป็นรายเดือนภายในวันที่ 5 ของทุกเดือนโดยผู้เช่าตกลงจะโอนเงินค่าเช่าเข้าบัญชีเงินฝากธนาคาร.................................... สาขา................................ ประเภทบัญชี......................หมายเลข............................................. ให้แก่ผู้ให้เช่า
ในกรณีที่ผู้เช่าชำระเงินช้ากว่าที่กำหนดผู้เช่ายินยอมเสียค่าปรับเพื่อเป็นค่าเสียหายเท่ากับอัตราดอกเบี้ยร้อยละ 15 ต่อปี จนกว่าจะชำระค่าเช่าครบถ้วน และการที่ผู้เช่าจะต้องจ่ายค่าเสียหายดังกล่าวจะ ไม่เป็นเหตุให้ผู้เช่ามีเหตุอ้างว่าได้ปฏิบัติตามสัญญาเช่าและหรือไม่ตัดสิทธิผู้ให้เช่าที่จะดำเนินการตามทาง แก้ในข้ออื่นของสัญญานี้

ข้อ 3. การใช้ทรัพย์ที่เช่า
ผู้ให้เช่าตกลงให้ผู้เช่าสร้างอาคารหรือสิ่งปลูกสร้างชั่วคราวได้ในทรัพย์ที่เช่า แต่เมื่อสัญญาสิ้นสุดลงและเมื่อผู้เช่าและบริวารออกจากสถานที่เช่าบรรดาสิ่งก่อสร้างหรือซ่อมแซมที่ติดตรึงตราถาวรในสถานที่เช่า ห้ามมิให้ผู้เช่ารื้อถอนหรือทำลายเป็นอันขาด และให้ตกเป็นกรรมสิทธิ์ของผู้ให้เช่าเว้นแต่จะได้รับความยินยอมเป็นลายลักษณ์อักษรจากผู้ให้เช่า
ข้อ 4. ข้อสัญญาของผู้เช่า
4.1ผู้เช่าสัญญาว่าผู้เช่าจะใช้สถานที่เช่า โดยมีวัตถุประสงค์เพื่อใช้เป็นที่อยู่อาศัยเท่านั้น และจะใช้สถานที่เช่าโดยผู้เช่าเท่านั้น เว้นแต่จะได้รับความยินยอมเป็นหนังสือจากผู้ให้เช่าว่ายินยอมให้ผู้อื่นร่วมใช้หรือใช้เพื่อการอื่น ถ้า ผู้เช่าปฏิบัติผิดสัญญาข้อนี้ ผู้ให้เช่ามีสิทธิเลือกปฏิบัติดังนี้คือ (ก) บอกเลิกสัญญาเช่าทันที (ข) คิดค่าปรับตามที่เห็นสมควร (ค) เพิ่มค่าเช่า (ง) บอกกล่าวให้ผู้เช่าระงับการกระทำดังกล่าวและคิดค่าเสียหาย ทั้งนี้ โดยผู้ให้เช่ามีสิทธิเลือกปฏิบัติอย่างใดอย่างหนึ่งหรือหลายอย่างรวมกันก็ได้ เว้นแต่ผู้ให้เช่ากับผู้เช่าจะได้ตกลงกันเป็นลายลักษณ์อักษร
4.2ผู้เช่าสัญญาว่า จะไม่ใช้หรืออนุญาตหรือปล่อยให้สถานที่เช่าหรือส่วนหนึ่งส่วนใดของสถานที่เช่า เป็นที่ประกอบกิจการผิดกฎหมายหรือผิดศีลธรรมอย่างใดทั้งสิ้น หรือโดยเป็นหรืออาจจะเป็นเหตุให้เป็นอันตรายต่อสุขภาพอนามัย หรือเป็นที่น่ารังเกียจ หรือก่อให้เกิดความเดือดร้อนรำคาญแก่ ผู้ให้เช่าหรือผู้อยู่ใกล้เคียง หรือบุคคลอื่น
4.3 ผู้เช่าสัญญาว่าจะไม่เก็บรักษาหรือนำเข้ามาในสถานที่เช่าซึ่งวัตถุที่อาจเกิดการเผาไหม้ได้ในตัวเอง วัตถุระเบิด วัตถุไวไฟ หรือของอื่นที่มีสภาพเป็นอันตราย
4.4 ผู้เช่าสัญญาว่า จะต้องสงวนรักษาและดูแลสถานที่เช่าเสมือนเช่นวิญญูชนจักพึงสงวนรักษาทรัพย์สินของตนเอง
4.5 ผู้เช่าสัญญาว่า ผู้เช่าจะไม่โอนสิทธิการเช่าในสถานที่เช่านี้ หรือนำสถานที่เช่าทั้งหมดหรือบางส่วนไปให้บุคคลอื่นเช่าช่วง หรือยอมให้บุคคลอื่นเข้าครอบครองหรือใช้ประโยชน์แทน ไม่ว่าเป็นการประจำหรือชั่วคราว เว้นแต่จะได้รับความยินยอมเป็นลายลักษณ์อักษรจากผู้ให้เช่า
4.6 ผู้เช่าต้องยินยอมให้ผู้ให้เช่าหรือตัวแทนของผู้ให้เช่า เข้าตรวจตราสถานที่เช่าได้ตามสมควรตลอดเวลาทำการของผู้เช่า และภายหลังจากนั้น เมื่อผู้ให้เช่าหรือตัวแทนของผู้ให้เช่าได้แจ้งให้ผู้เช่าทราบเป็นลายลักษณ์อักษรว่า ผู้เช่ามีหน้าที่ต้องซ่อมแซมสิ่งชำรุดบกพร่องหรือสิ่งอื่นใดที่ผู้เช่ามีหน้าที่ต้องกระทำตามสัญญานี้แล้ว ผู้เช่าจะต้องปฏิบัติภายในหนึ่งเดือนนับแต่วันที่ได้รับแจ้ง ทั้งนี้เว้นแต่การชำรุดนั้นเป็นการเสื่อมโทรมตามสภาพการใช้ ในกรณีผู้เช่าไม่ซ่อมหรือไม่ปฏิบัติให้แล้วเสร็จภายในหนึ่งเดือนนับแต่วันที่ได้รับแจ้ง ผู้ให้เช่ามีสิทธิเข้าไปในสถานที่เช่าและจัดการซ่อมแซมเอง โดยผู้เช่าต้องเป็นผู้ออกค่าใช้จ่ายการซ่อมแซมต่าง ๆ นั้น
4.7 ผู้เช่าสัญญาว่าผู้เช่าจะปฏิบัติตามข้อบังคับหรือระเบียบต่าง ๆ ที่ผู้ให้เช่ากำหนดขึ้น
4.8ผู้เช่าสัญญาว่า ในกรณีผู้เช่าปฏิบัติผิดสัญญาข้อหนึ่งข้อใดหรือตกเป็นบุคคลล้มละลายหรือคนไร้ความสามารถ หรือถูกยึดหรือถูกอายัดทรัพย์ หรือกระทำการอื่นใด ซึ่งตามกฎหมาย ถือได้ว่าเป็น

การประพฤติผิดสัญญา ไม่ว่าผู้ให้เช่าจะบอกกล่าวให้ปฏิบัติหรือไม่ก็ตาม ถือว่าสัญญานี้เป็นอันเลิกกันทันที ผู้ให
