หนังสือสัญญาฉบับนี้ ทำขึ้นเมื่อวันที่ 5 ธันวาคม 2557 ระหว่างโรงแรมป่าตองรีสอร์ท โดยนายนิรันดร์ สิงห์ฆาฬะ ผู้รับมอบอำนาจ อยู่บ้านเลขที่ 43/1 หมู่ 2 ตำบลไม้ขาว อำเภอถลาง จังหวัดภูเก็ต 83110 ซึ่งในสัญญาฉบับนี้เรียกว่า “ผู้ว่าจ้าง” ฝ่ายหนึ่ง กับ นางสาว............ ซึ่งต่อไปนี้เรียกว่า “ผู้รับจ้าง” อีกฝ่ายหนึ่ง ทั้งสองได้ตกลงทำสัญญากันโดยมีรายละเอียด และสาระสำคัญดังต่อไปนี้
1. การว่าจ้าง
ผู้ว่าจ้างตกลงว่าจ้างและผู้รับจ้างตกลงรับจ้างเพื่อเป็นพิธีกร ในงานศริสมาสต์ วันที่ 24 ธันวาคม 2557 และงานปีใหม่ 2015 ในวันที่ 31 ธันวาคม 2557 ณ โรงแรมป่าตองรีสอร์ท บ้านเลขที่ 208 ถนนราษฎร์อุทิศ 200 ปี ตำบลป่าตอง อำเภอกระทู้ จังหวัดภูเก็ต ทั้งนี้ผู้รับจ้างตกลงจะเข้าร่วมกิจกรรมกับผู้ว่าจ้างตามกำหนดระยะเวลาที่ผู้ว่าจ้างได้จ้างไว้โดยจะมาทำงาน รวมจำนวนทั้งสิ้น 2 ครั้ง
2. ระยะเวลาการว่าจ้าง
ผู้ว่าจ้างและผู้รับจ้างตกลงกันว่าจะดำเนินการตามสัญญาข้อ 1 ภายในระยะเวลา 19.40 - 22.15 น. หรือมีเหตุสุดวิสัยไม่สามารถจัดแสดงในระยะเวลาตามสัญญา ผู้ว่าจ้างสามารถตกลงกับผู้รับจ้างกำหนดเวลาตามความเหมาะสมโดยทั้งสองฝ่ายเห็นสมควร
3. ค่าตอบแทน
ผู้ว่าจ้างตกลงจะชำระค่าตอบแทนให้ผู้รับจ้างจากการเป็นพิธีกร ตามสัญญาข้อที่ 1 เป็นจำนวนเงินทั้งสิ้น 15,000 บาท (สามหมื่นห้าพันบาทถ้วน) และหักภาษี ณ ที่จ่าย 3% ผู้รับจ้างจะเป็นผู้รับผิดชอบ
การจ่ายเงิน ตามเงื่อนไข แห่งสัญญานี้ผู้ว่าจ้างจะสั่งค่าพิธีกรโดยจ่ายเป็นเช็คเงินสด ภายในวันที่ 2 ธันวาคม 2557 หลังจากเสร็จสิ้นการแสดงตามข้อ 1 เป็นที่เรียบร้อยแล้ว
ในกรณีที่ผู้รับจ้างมาทำการแสดงล้าช้าผู้รับจ้างจะต้องชดใช้ค่าเสียหายโดยหักคิดเป็น 20% ของจำนวนเงินของการแสดง
4. การแก้ไขสัญญา
การเพิ่มเติม ตัดทอน แก้ไขหรือเปลี่ยนแปลงสัญญานี้ จะมีผลใช้บังคับได้ก็ต่อเมื่อคู่สัญญาทั้ง
สองฝ่ายได้ตกลงและลงนามร่วมกันเป็นลายลักษณ์อักษร

5. กรณีที่คู่สัญญาฝ่ายใดฝ่ายหนึ่งไม่ปฏิบัติตามสัญญาไม่ว่าข้อหนึ่งข้อใดเป็นเหตุให้เกิดความเสียหายแก่อีกฝ่ายแล้ว คู่สัญญาฝ่ายที่ไม่ได้ปฏิบัติตามสัญญาตกลงยอมรับผิดและยินยอมชดใช้ค่าเสียหายอันเกิดจากการไม่ปฏิบัติตามสัญญานั้นให้แก่คู่สัญญาอีกฝ่ายภายใน 15 (สิบห้า) วัน นับแต่วันได้รับแจ้งเป็นลายลักษณ์อักษรจากคู่สัญญาฝ่ายที่ไม่ต้องรับผิด ทั้งนี้จะไม่ตัดสิทธิ ของคู่สัญญาอีกฝ่ายในการบอกเลิกสัญญาและเรียกค่าเสียหายได้
หนังสือสัญญาฉบับนี้เป็นสองฉบับ มีข้อความถูกต้องตรงกัน คู่สัญญาทั้งสองฝ่ายได้อ่านและเข้าใจข้อความในสัญญานี้โดยตลอดแล้ว เห็นว่าถูกต้องตามเจตนาของคู่สัญญาทั้งสองฝ่าย จึงลงลายมือชื่อไว้เป็นสำคัญต่อหน้าพยาน
