จำเลยซึ่งเป็นผู้ว่าจ้างเป็นผู้กำหนดวิธีการให้ผู้รับจ้างตัดต้นไม้และให้คนควบ คุมดูแลการตัดต้นไม้ตลอดเวลา แต่ในวันที่มีการตัดต้นไม้และทำให้ไม้ล้มพาดสายไฟฟ้าแรงสูงในที่ดินของโจทก์ ขาดก่อให้เกิดความเสียหายกลับไม่มีผู้ใดควบคุม การที่ผู้รับจ้างไม่มีความรู้ความชำนาญในการตัดต้นไม้ที่จะก่อให้เกิดความ เสียหายแก่สิ่งก่อสร้างข้างเคียงหรือไม่ยอมทำตามวิธีการที่ถูกต้อง ถือได้ว่าจำเลยเป็นผู้ผิดในส่วนการงานที่สั่งให้ทำ หรือในคำสั่งที่ให้ไว้ หรือในการเลือกหาผู้รับจ้าง จำเลยจึงต้องรับผิดต่อโจทก์ตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 428
