สัญญานี้ทำขึ้นระหว่าง Prasit Enterprise&Freight Co.,Ltd. โดย นายประสิทธิ์ สวัสดี ผู้มีอำนาจลงนาม ตั้งอยู่ที่ 244/45 ซอย/ถนน สุขุมวิท (หมู่บ้านกรีลวิลล์) ต.นาเกลือ ต.บางลมุง เมื่องพัทยา จ.ชลบุรี ซึ่งต่อไปในสัญญานี้ เรียกว่า “ผู้ให้เช่า” ฝ่ายหนึ่ง กับ Munkfors Trading Co.,Ltd. โดยนาย / นางสาว สำนักงานสาขาตั้งอยู่เลขที่
ซึ่งต่อไปในสัญญานี้ขอเรียกว่า “ผู้เช่า” อีกฝ่ายหนึ่ง ทั้งสองฝ่าย ตกลงทำสัญญากัน ดังมีข้อความดังต่อไปนี้ เอกสารแนบท้ายสัญญาให้ถือว่าเป็นส่วนหนึ่งของสัญญาฉบับนี้ได้แก่
1.แผนผังพื้นที่ให้เช่า
ข้อ 1. พื้นที่ที่เช่า
“ผู้เช่า” และ ”ผู้ให้เช่า” ตกลงให้เช่าพื้นที่ห้องเลขที่ 114-115 ในตัวอาคารบริเวณชั้นที่ 1 บางส่วนของอาคารตั้งอยู่ที่ 169/16 ม.5 ต.หนองขาม อ.ศรีราชา จ.ชลบุรี 20230 จำนวน 63.75 ตารางเมตร โดยเริ่มสัญญาตั้งแต่วันที่ …1 กุมภาพันธ์ 2558 ถึงวันที่ 1 กันยายน 2558
อนึ่ง ค่าภาษีต่างๆ ที่เกี่ยวกับพื้นที่บริการรวมทั้งภาษีโรงเรือนผู้เช่าหรือผู้เช่าช่วงเป็นผู้ชำระเองทั้งสิ้น
เมื่อสิ้นสุดระยะเวลาการให้บริการ หาก “ผู้เช่า”ประสงค์จะต่ออายุสัญญาต่อไป “ผู้เช่า”จะต้องส่งคำบอกกล่าวเป็นลายลักษณ์อักษรต่อ “ผู้ให้เช่า” เป็นเวลาอย่างน้อย 90 วัน ก่อนสิ้นสุดระยะเวลาบริการตามสัญญาเช่านี้ และให้”ผู้ให้เช่า” เป็นผู้พิจารณาข้อเสนอในคำบอกกล่าวในการต่อสัญญา

ข้อ 2. “ผู้เช่า”หรือผู้เช่าช่วงจะเป็นผู้ออกค่าสาธารณูปโภคที่ผู้เช่าใช้ในแต่ละเดือนเอง
2.1”ผู้เช่า”ตกลงเช่าห้องเลขที่ 114-115 และ“ผู้ให้เช่า”ตกลงให้เช่าพื้นที่ห้องในตัวอาคารบริเวณชั้นที่ 1 บางส่วน ขนาด 63.75 ตารางเมตรๆ ละ 150 บาท พื้นที่เช่าปรากฏตามแผนผังพื้นที่เช่าที่แนบมาท้ายสัญญาฉบับนี้
2.2 “ผู้เช่า”จะเป็นผู้ออกค่าสาธารณูปโภคที่ผู้เช่าใช้ในแต่ละเดือนเอง โดยชำระให้แก่ “ผู้ให้เช่า” ในอัตราดังนี้ ค่าไฟฟ้า หน่วยละ 7 บาท โดย “ผู้ให้เช่า” จะออกใบแจ้งหนี้ให้ทุกวันที่ 1 ของเดือน ค่าน้ำประปาหน่วยละ 30 บาท
ข้อ 3. การชำระเงิน
3.1”ผู้เช่า”ตกลงชำระค่าเช่าให้แก่”ผู้ให้เช่า” ดังนี้ ค่าเช่ารายเดือน เดือนละ 9,563.-บาท (เก้าพันห้าร้อยหกสิบสามบาทถ้วน) และเงินประกันความเสียหาย 2 เดือน เป็นเงิน 19,126 บาท (หนี่ง
3.2 ตั้งแต่วันที่ 30 มกราคม 2558 ผู้เช่าตกลงจะชำระเงินให้”ผู้ให้เช่า” และต้องชำระเงินไม่เกินวันที่ 3 ของทุกเดือน โดยในวันทำสัญญานี้ ”ผู้เช่า” จะวางเงินประกันจำนวน 28,689.-บาท (สองหมื่นแปดพันหกร้อยแปดสิบเก้าบาทถ้วน) ถ้า”ผู้เช่า”กระทำผิดสัญญาข้อหนึ่งข้อใดหรือหลายข้อรวมกัน ”ผู้ให้เช่า” ริปเงินประกันและมีสิทธิเรียกร้องให้ปฏิบัติตามสัญญาและเรียกค่าเสียหายได้ หรือจะบอกเลิกสัญญาและให้”ผู้เช่า” ย้ายออกจากทรัพย์สินที่เช่าภายใน 15 วันก็ได้
ข้อ 4. หากมีภาระภาษีโรงเรือนที่จะต้องชำระอันเนื่องมาจากการให้เช่าพื้นที่ตามสัญญานี้”ผู้เช่าหรือผู้เช่าช่วง”จะเป็นผู้รับผิดชอบค่าภาษีโรงเรือนของพื้นที่
ข้อ 5. เมื่อครบกำหนดสัญญาเช่า ”ผู้เช่า” มีสิทธิรื้อถอนเฉพาะทรัพย์สินอันเป็นสังหาริมทรัพย์และอุปกรณ์ต่างๆ ออกไปจากบริเวณที่ทำสัญญาได้ ส่วนทรัพย์สินที่เป็นอสังหาริมทรัพย์ ส่วนควบกับโครงสร้างของอาคารต้องตกเป็นของ ”ผู้ให้เช่า” ยกเว้นจะได้รับอนุญาตเป็นลายลักษณ์อักษรจาก ”ผู้ให้เช่า” และส่งมอบสถานที่ในสภาพดี พร้อมทำความสะอาด ภายในกำหนดระยะเวลา 15 วัน
หากมีความเสียหายใด ๆ เกิดขึ้นแก่”ผู้ให้เช่า”หรือบุคคลภายนอกอันเนื่องมาจากการกระทำของ ”ผู้เช่าหรือผู้เช่าช่วง” ตัวแทน ลูกจ้าง หรือบริวารของ”ผู้เช่าหรือผู้เช่าช่วง” ”ผู้เช่าและผู้เช่าช่วง”จะต้องรับผิดชอบชดใช้ความเสียหายนั้นทั้งสิ้น
ข้อ 6. การตกแต่ง

”ผู้เช่า” จะไม่แก้ไขเปลี่ยนแปลง เพิ่มเติม หรือโอนสิทธิในสัญญานี้ ไม่ว่าจะเป็นเงื่อนไขตามที่แนบท้าย หรือเอกสารทางกฎหมายอื่นที่ประกอบเป็นสัญญานี้ โดยลงนามข้อตกลงหรือให้ความยินยอมใดเกี่ยวกับสัญญาบริการนี้ไม่ว่าด้วยประการใดก็ตาม โดยมิได้รับความยินยอมเป็นลายลักษณ์อักษรจาก”ผู้ให้เช่า”ก่อน
ข้อ 8. คู่สัญญาอาจตกลงร่วมกันในการแก้ไขเปลี่ยนแปลง หรือเพิ่มเติมสัญญานี้ รวมถึงเอกสารแนบท้ายสัญญาบริการหรือทำข้อตกลงหรือให้คำยินยอมใดๆ เกี่ยวกับสัญญานี้ได้โดยทำเป็นหนังสือลงนามโดยกรรมการผู้มีอำนาจ หรือตัวแทน ของคู่สัญญาแต่ละฝ่าย
ข้อ 9. หากมีเหตุจำเป็น “ผู้ให้เช่า”จำเป็นต้องใช้พื้นที่ส่วนกลางหรือพื้นที่ที่”ผู้เช่า”ใช้ร่วมกันอันไม่เกี่ยวข้องกับพื้นที่เช่าของ”ผู้เช่าหรือผู้เช่าช่วง”เพื่อจัดกิจกรรมของ”ผู้ให้เช่า” “ผู้เช่า” จะยินยอมให้ใช้พื้นที่ดังกล่าวตามความจำเป็นนั้นโดยที่ “ผู้ให้เช่า” ต้องแจ้งให้ทราบล่วงหน้าอย่างน้อย 3 วันทำการ เพื่อเป็นการเตรียมพื้นที่ให้บริการ

”ผู้ให้เช่า” มีสิทธิบอกเลิกสัญญาเช่าฉบับนี้ โดยการส่งคำบอกกล่าวเป็นลายลักษณ์อักษรแก่”ผู้เช่า” ในกรณีที่”ผู้เช่า” ทำผิดข้อกำหนดในสัญญาข้อใดข้อหนึ่งของสัญญาเช่าพื้นที่หรือข้อตกลงที่เกี่ยวข้องใดๆที่กระทำกับ”ผู้ให้เช่า”
ข้อที่ 11. คู่สัญญาทั้งสองฝ่ายตกลงว่าภูมิลำเนาที่ปรากฏอยู่ในสัญญาเป็นภูมิลำเนาที่แท้จริงของตน โดยคู่สัญญาอีกฝ่ายหนึ่งสามารถติดต่อส่งเอกสาร จดหมาย และสรรพเอกสาร ดำเนินการใดๆได้ ณ ภูมิลำเนาดังกล่าวแห่งเดียวและหากคู่สัญญาย้ายหรือเปลี่ยนแปลงภูมิลำเนาขอให้แจ้งคู่สัญญาอีกฝ่ายหนึ่งทราบเป็นลายลักษณ์อักษรภายในวันที่ 7 วันนับแต่วันที่ได้มีการเปลี่ยนแปลงภูมิลำเนาตามสัญญา
