3. การซื้อยา และเวชภัณฑ์ที่ไม่ใช่ยา เช่น ผ้าก๊อส สำลี หลอดฉีดยา เข็มฉีดยา เฝือก วัสดุทันตกรรม ฟิล์มเอกซ์เรย์ และเภสัชเคมีภัณฑ์ ซึ่งองค์การเภสัชกรรมได้ผลิตออกจำหน่ายแล้ว ให้จัดซื้อจากองค์กรการเภสัชกรรมทหาร ส่วนกรมตำรวจจะซื้อจากองค์กรเภสัชกรรมหรือโรงงานเภสัชกรรมทางทหารก็ได้ โดยให้ดำเนินการด้วยวิธีกรณีพิเศษ แต่ครั้งนี้ราคายาที่องค์การเภสัชกรรมหรือโรงงานเภสัชกรรมทางทหารจำหน่ายต้องไม่สูงกว่าราคากลางของยาชื่อสามัญเดียวกันที่กระทรวงสาธารณสุขกำหนดเกินร้อยละ 3
4. การซื้อยาตามชื่อสามัญในบัญชียาหลักแห่งชาติและเวชภัณฑ์ที่ไม่ใช่ยา ซึ่งองค์การเภสัชกรรมมิได้เป็นผู้ผลิต แต่มีจำหน่าย ส่วนราชการจะจัดซื้อจากองค์การเภสัชกรรม หรือผู้ขาย หรือผู้ผลิตรายใดก็ได้ ภายใต้หลักเกณฑ์ ดังนี้
(1) การจัดซื้อโดยวิธีสอบราคา หรือประกวดราคาให้ส่วนราชการแจ้งให้องค์การเภสัชกรรมทราบด้วยทุกครั้ง และถ้าผลสอบราคาหรือประกวดราคาปรากฏว่าองค์การเภสัชกรรมเสนอราคาเท่ากันหรือต่ำกว่าผู้เสนอราคารายอื่น ให้ส่วนราชการซื้อจากองค์การเภสัชกรรม
(2) จากการจัดซื้อโดยวิธีตกลงราคาหรือวิธีพิเศษ ให้ซื้อในราคาที่มาสูงกว่าราคากลาง ที่กระทรวงสาธารณสุขกำหนด
5. ในกรณีที่มีกฎหมาย หรือมติคณะรัฐมนตรีกำหนดให้ความสนับสนุนให้ซื้อยาและเวชภัณฑ์ที่มิใช่ยาจากหน่วยงานดังกล่าว โดยวิธีกรณีพิเศษด้วย
