2.3 ผู้ขายรับรองว่าน้ำมันเชื้อเพลิงที่ขายให้ตามข้อตกลงนี้มีคุณภาพและมาตรฐานเป็นไปตามที่ทางราชการกำหนดไว้ และเป็นน้ำมันเชื้อเพลิงที่ส่งโดยตรงจากบริษัทซึ่งเป็นเจ้าของเครื่องหมายการค้าของสถานีบริการน้ำมันเชื้อเพลิงของผู้ขาย
2.4 ให้ผู้ซื้อ ส่งมอบเอกสารสำคัญของผู้ซื้อ อันได้แก่ หนังสือรับรองบริษัท หนังสือมอบอำนาจ และเอกสารอื่น ๆ ที่จำเป็นในการทำสัญญาซื้อขายน้ำมันเชื้อเพลิงให้แก่ ผู้ขาย ภายใน 7 วันนับแต่วันทำสัญญา
2.5หลังจากทำสัญญาซื้อขายและรับมอบเอกสารสำคัญของผู้ซื้อแล้ว ผู้ขายจะแจ้งผู้ซื้อภายใน 30 วันเพื่อส่งมอบ น้ำมันเชื้อเพลิง ตามที่ตกลงในสัญญาดังกล่าว

ข้อ 3 การส่งมอบ
ผู้ขายจะต้องส่งมอบน้ำมันเชื้อเพลิงเป็นคราว ๆ ตามชนิดและจำนวนน้ำมันเชื้อเพลิง ตามหลักฐานใบสั่งจ่ายน้ำมันเชื้อเพลิงของผู้ซื้อ
3.1 โดยผู้ซื้อจะรับน้ำมันเชื้อเพลิง ณ สถานีบริการน้ำมันเชื้อเพลิงของผู้ขายและผู้ซื้อจะแสดงหลักฐานใบสั่งจ่ายน้ำมันเชื้อเพลิงที่มีลายมือชื่อผู้มีอำนาจสั่งจ่าย หมายเลขทะเบียนรถยนต์ หมายเลข ชป.รถยนต์ รายชื่อพนักงานขับรถยนต์ เฉพาะที่ได้ระบุไว้ในเอกสารแนบท้ายข้อตกลง และผู้ขายจะต้องออกใบส่งของที่ระบุ ชนิดน้ำมันเชื้อเพลิง จำนวนลิตร ราคาน้ำมันเชื้อเพลิงต่อลิตร จำนวนเงิน เลขที่ใบสั่งจ่าย หมายเลขทะเบียนรถยนต์ หมายเลข ชป.รถยนต์ ทุกครั้งที่มีการจ่ายน้ำมันเชื้อเพลิงให้กับพนักงานขับรถยนต์ เพื่อที่ผู้ซื้อจะนำมาเป็นหลักฐานประกอบการชำระเงิน

ข้อ 4 การชำระเงิน

ข้อ 5 กำหนดระยะเวลาของข้อตกลง

ข้อ 6 การบอกเลิกสัญญา
ถ้าผู้ขายไม่สามารถส่งมอบน้ำมันเชื้อเพลิงให้แก่ผู้ซื้อ หรือส่งมอบไม่ถูกต้องหรือไม่ครบจำนวนตามใบสั่งจ่ายน้ำมันเชื้อเพลิง หรือผู้ขายปฏิบัติหรือไม่ปฏิบัติอันเป็นการผิดข้อตกลงข้อหนึ่งข้อใดหรือตกเป็น ผู้ล้มละลาย ผู้ซื้อมีสิทธิบอกเลิกข้อตกลงทั้งหมดหรือบางส่วนก็ได้

ข้อ 7 ค่าปรับ
กรณีผู้ซื้อไม่ใช้สิทธิบอกเลิกข้อตกลงเมื่อผู้ขายได้รับใบสั่งจ่ายน้ำมันเชื้อเพลิงจากผู้ซื้อและผู้ขาย ไม่สามารถส่งมอบน้ำมันเชื้อเพลิงให้แก่ผู้ซื้อในคราวใด ผู้ขายจะต้องชำระค่าปรับให้ผู้ซื้อในอัตราร้อยละ

ข้อ 8 การรับผิดชดใช้ค่าเสียหาย
