พระราชบัญญัติการขนส่งทางบก พ.ศ.2522 เป็นพระราชบัญญัติหลักที่ควบคุมดูแลการบริการรถตู้ปรับอากาศสำหรับนักท่องเที่ยว ซึ่งในมาตรา 4 ของพระราชบัญญัติดังกล่าวระบุว่า (1) “การขนส่งประจำทาง” หมายความว่า การขนส่งเพื่อสินจ้างตามเส้นทางที่คณะกรรมการกำหนด และ (2) “การขนส่งไม่ประจำทาง” หมายความว่า การขนส่งเพื่อสินจ้างโดยไม่จำกัดเส้นทาง (สำนักงานคณะกรรมการกฤษฎีกา, 2522: 1) ซึ่งรถตู้ปรับอากาศสำหรับนักท่องเที่ยวมีทั้งที่เป็นการขนส่งประจำทางและไม่ประจำทาง โดยในมาตรา 23 และ 24 (สำนักงานคณะกรรมการกฤษฎีกา, 2522: 6-7) กำหนดให้ผู้ประกอบการขนส่งสำหรับรถดังกล่าวจะต้องได้รับใบอนุญาตประกอบการขนส่งประจำทางหรือการขนส่งไม่ประจำทางตามแต่วัตถุประสงค์ ซึ่งผู้ประกอบการดังกล่าวจะต้องมีสัญชาติไทย
