กระทรวงพาณิชย์ โดยกรมพัฒนาธุรกิจการค้า ผนึกกำลังสำนักงานปลัดกระทรวงการท่องเที่ยวและกีฬา กรมการท่องเที่ยว และกรมสอบสวนคดีพิเศษ ร่วมปราบปรามนอมินีท่องเที่ยว โดยกำหนดลงนามบันทึกข้อตกลงความร่วมมือการแก้ไขปัญหาการประกอบธุรกิจท่องเที่ยวโดยใช้คนไทยเป็นตัวแทนอำพราง (Nominee) ในวันพุธที่ ๒๔ ธันวาคม ๒๕๕๗ ณ ศูนย์ฝึกอบรมพัฒนาธุรกิจการค้า ชั้น 6 กรมพัฒนาธุรกิจการค้า สนามบินน้ำ จังหวัดนนทบุรี
นางอภิรดี ตันตราภรณ์ รัฐมนตรีช่วยว่าการกระทรวงพาณิชย์ เปิดเผยว่า คณะกรรมการนโยบาย การท่องเที่ยวแห่งชาติ (ท.ท.ช.) มอบหมายกระทรวงพาณิชย์เป็นเจ้าภาพหลักในการแก้ไขปัญหาผู้ประกอบธุรกิจเป็นตัวแทนชาวต่างชาติ (Nominee) ซึ่งได้มอบหมายกรมพัฒนาธุรกิจการค้าเป็นหน่วยงานหลักในการดำเนินงานตามนโยบายของ ท.ท.ช. โดยได้ร่วมมือกับสำนักงานปลัดกระทรวงการท่องเที่ยวและกีฬา กรมการท่องเที่ยว และกรมสอบสวนคดีพิเศษ จัดตั้งคณะทำงานพร้อมจัดทำร่างบันทึกข้อตกลงความร่วมมือ (MOU) เพื่อแก้ไขปัญหาดังกล่าวร่วมกัน และกำหนดพิธีลงนามบันทึกข้อตกลงความร่วมมือการแก้ไขปัญหา การประกอบธุรกิจท่องเที่ยวโดยใช้คนไทยเป็นตัวแทนอำพราง (Nominee) ระหว่าง ๔ หน่วยงาน ในวันที่ ๒๔ ธันวาคม ๒๕๕๗ โดยมีกรอบความร่วมมือ ๔ ด้าน คือ ด้านการจดทะเบียนและการอนุญาต ด้านการประสานแลกเปลี่ยนข้อมูล ด้านกำกับดูแลและป้องปราม และด้านการส่งเสริมธุรกิจท่องเที่ยว
สำหรับขอบเขตความร่วมมือในส่วนของกรมพัฒนาธุรกิจการค้า ด้านต่างๆ ได้กำหนดไว้ คือ ด้านการรับจดทะเบียนนิติบุคคลที่ประกอบธุรกิจท่องเที่ยว จะให้ความสำคัญกับการอนุญาตให้ประกอบธุรกิจท่องเที่ยวจากกรมการท่องเที่ยวก่อนจดทะเบียน และสนับสนุนการเชื่อมโยงแลกเปลี่ยนข้อมูล ทั้งข้อมูลการจดทะเบียน ข้อมูลผู้ถือหุ้น รวมทั้งข้อมูลของผู้ประกอบธุรกิจที่อาจมีพฤติกรรมในลักษณะนอมินี เพื่อให้แต่ละหน่วยงานใช้เป็นฐานข้อมูลในการตรวจสอบและดำเนินการ ด้านการกำกับดูแลและป้องปรามโดยร่วมจัดตั้งคณะทำงานแก้ไขปัญหาการประกอบธุรกิจท่องเที่ยวโดยใช้คนไทยเป็นตัวแทนอำพรางร่วมกับหน่วยงานพันธมิตรเพื่อจัดทำแผนปฏิบัติการและลงตรวจสอบในพื้นที่เป้าหมายร่วมกัน ตลอดจนสนับสนุนส่งเสริม พัฒนาเพื่อยกระดับมาตรฐานคุณภาพของผู้ประกอบธุรกิจท่องเที่ยวให้มีความเข้มแข็งอย่างยั่งยืน
กรมพัฒนาธุรกิจการค้า ขอเตือนคนไทยที่ให้ความช่วยเหลือ สนับสนุนหรือถือหุ้นแทน คนต่างด้าว ซึ่งจะมีความผิดทั้งคนไทยและคนต่างด้าว โดยมีโทษจำคุกไม่เกิน ๓ ปี หรือปรับตั้งแต่ ๑๐๐,๐๐๐ – ๑,๐๐๐,๐๐๐ บาท หรือทั้งจำทั้งปรับ และยังมีโทษปรับรายวันอีกวันละ ๑๐,๐๐๐ บาท
