ชาวต่างชาติที่ประสงค์จะรับเด็กไทยเป็นบุตรบุญธรรมสามารถกระทำได้ ดังนี้

1. การแสดงความจำนงขอรับเด็กเป็นบุตรบุญธรรม
• ชาวต่างประเทศที่มีภูมิลำเนาในต่างประเทศ ให้ยื่นคำขอต่อส่วนราชการที่มีอำนาจหน้าที่ในเรื่องการรับเด็กเป็นบุตรบุญธรรมของประเทศที่ผู้นั้นมีภูมิลำเนาหรือหน่วยงานที่รัฐบาลของประเทศนั้นมอบหมาย หรือองค์การสวัสดิภาพเด็กที่รัฐบาลของประเทศนั้นอนุญาตให้ดำเนินการเพื่อให้มีการรับเด็กเป็นบุตรบุญธรรมระหว่างประเทศ
• ชาวต่างประเทศที่มีภูมิลำเนาอยู่ในประเทศไทย และมีหลักฐานหนังสือสำคัญประจำตัวต่างด้าว ให้ยื่นคำขอรับเด็กเป็นบุตรบุญธรรมที่ศูนย์อำนวยการรับเด็กเป็นบุตรบุญธรรม (Child Adoption Centre) กรมพัฒนาสังคมและสวัสดิการ กระทรวงความมั่นคงและทรัพยากรมนุษย์ กรุงเทพมหานคร โทร 02- 2468651 โทรสาร 02-2479480
•ชาวต่างประเทศที่มีถิ่นที่อยู่ชั่วคราวในประเทศไทยและมีหนังสืออนุญาต การทำงานจากกรมแรงงานมาแสดง และอาศัยในประเทศไทยไม่น้อยกว่า 1 ปี ก่อนวันยื่นคำขอ และมีระยะเวลาสำหรับการทดลองเลี้ยงดูเด็กในประเทศได้ครบกำหนด ให้ยื่นคำขอรับเด็กเป็นบุตรบุญธรรมที่ศูนย์อำนวยการรับเด็กเป็นบุตรบุญธรรม โดยเอกสารต่าง ๆ จะต้องได้รับการรับรองจากสถานเอกอัครราชทูตหรือสถานกงสุล ประจำประเทศไทยของผู้ขอรับเด็กเป็นบุตรบุญธรรมนั้นด้วย

2. คุณสมบัติเบื้องต้นของผู้ขอรับเด็ก
• ผู้ขอรับเด็กจะต้องมีอายุเกินกว่า 25 ปี และต้องมากกว่าเด็กอย่างน้อย 15 ปี
• จะต้องมีคู่สมรส เว้นแต่ผู้ขอรับเด็กเป็นบุตรบุญธรรมเป็นผู้ที่มีสัญชาติไทย
• จะต้องเป็นผู้ที่มีคุณสมบัติที่จะรับเด็กเป็นบุตรบุญธรรมได้ตามกฎหมายของประเทศ ที่ผู้ขอรับมีภูมิลำเนาอยู่ และจะต้องมีภูมิลำเนาอยู่ในประเทศที่มีความสัมพันธ์ทางการทูตกับประเทศไทย

3. การจัดส่งเอกสาร

ก. ฝ่ายผู้ขอรับเด็ก
ผู้ขอรับเด็กต้องติดต่อส่วนราชการที่มีอำนาจหน้าที่ในเรื่องการรับเด็กเป็นบุตรบุญธรรม หรือหน่วยงานที่รัฐบาลประเทศนั้นมอบหมาย หรือองค์การเอกชนที่รัฐบาลของประเทศนั้นอนุญาตให้ดำเนินการเรื่องบุตรบุญธรรม เพื่อจัดหาเอกสารต่างๆ ดังนี้
• รายงานการศึกษา ภาพครอบครัวของผู้ขอรับเด็กเป็นบุตรบุญธรรม
• หนังสือรับรองความเหมาะสมที่จะรับเด็กเป็นบุตรบุญธรรม
• หนังสือรับรองว่าจะทำการควบคุมการทดลองเลี้ยงดูและส่งรายงานผลการทดลองเลี้ยงดูมาให้กรมประชาสงเคราะห์ไม่เกินสองเดือนต่อครั้งเป็นระยะเวลาหกเดือน
• แบบคำขอรับบุตรบุญธรรม (Application Form)
•เอกสารรับรองสุขภาพของผู้ขอรับเด็กจากแพทย์

• กรณีติดต่อผ่านองค์การสวัสดิภาพเด็กเอกชนจะต้องมีสำเนาในอนุญาตขององค์กร และหนังสือจากหน่วยงานรัฐบาลซึ่งรับรององค์กรนั้น ๆ ด้วย ทั้งนี้

เอกสารทุกฉบับดังกล่าวข้างต้นจะต้องได้รับการรับรองโดยสถานเอกอัครราชทูตหรือสถานกงสุลไทยในประเทศที่ผู้ขอรับเด็กอยู่หรือจัดส่งผ่านช่องทางทางการทูต

ข. ฝ่ายที่จะยกเด็กให้
• บัตรประจำตัวประชาชนของบิดามารดาหรือผู้ปกครอง
• ทะเบียนบ้าน
• ทะเบียนสมรส
• ทะเบียนหย่า หรือคำสั่งศาล

ค. ฝ่ายเด็กที่จะเป็นบุตรบุญธรรม

4. ขั้นตอนการดำเนินเรื่อง

• กรณีที่ขอรับเด็กกำพร้าของกรมพัฒนาสังคมและสวัสดิการ เมื่อคณะกรรมการการรับเด็กเป็นบุตรบุญธรรมพิจารณาอนุมัติคุณสมบัติผู้ขอรับเด็กแล้วคณะกรรมการการคัดเลือกเด็กให้เป็นบุตรบุญธรรมจะพิจารณาคัดเลือกเด็กกำพร้าของกรม ฯ ให้แก่ผู้ขอรับตามบัญชีก่อนหลัง
• กรมพัฒนาสังคมและสวัสดิการ จะแจ้งประวัติเด็กพร้อมรูปถ่ายให้ผู้ขอรับพิจารณาผ่านหน่วยงานที่ติดต่อเรื่องนี้มา
