นักโทษ หมายถึง ผู้ต้องขังที่อยู่ภายในทัณฑสถาน โดยในพ.ศ. 2549 มีนักโทษที่อยู่ในความดูแลของกรมราชทัณฑ์ 161,844 คน[ต้องการอ้างอิง]

ต่อมาในพระราชบัญญัติราชทัณฑ์ (ฉบับที่ 3) พ.ศ. 2522 เปลี่ยนความหมายของนักโทษเด็ดขาดเป็น “บุคคลซึ่งถูกขังไว้ตามหมายจำคุกภายหลังคำพิพากษาถึงที่สุด และหมายความรวมถึงบุคคลซึ่งถูกขังไว้ตามคำสั่งที่ชอบด้วยกฎหมาย ให้ลงโทษด้วย”
