มาตรา ๔ ในพระราชบัญญัตินี้
“แฟรนไชส์” หมายความว่า
(๑) การประกอบธุรกิจที่บุคคลหนึ่งเรียกว่า “แฟรนไชส์ซอร์” ตกลงให้บุคคลอีกคนหนึ่ง
เรียกว่า “แฟรนไชส์ซี” ใช้สิทธิในทรัพย์สินทางปัญญาของตน หรือที่ตนมีสิทธิที่จะให้ผู้อื่น ประกอบธุรกิจภายในระยะเวลาหรือเขตพื้นที่ที่กำหนด และการประกอบธุรกิจนั้นภายใต้การส่งเสริมและควบคุมตามแผนการดำเนินธุรกิจของ แฟรนไชส์ซอร์ และแฟรนไชส์ซีมีหน้าที่ต้องจ่ายค่าตอบแทนแก่แฟรนไชส์ซอร์
