ถ้าผู้รับจ้างไม่สามารถทำงานให้แล้วเสร็จบริบูรณ์ภายใน ผู้ว่าจ้างมีสิทธิจะบอกเลิกสัญญา



ข้อ ๓. ในวันทำสัญญานี้ ผู้รับจ้างได้นำหลักประกันเป็นหนังสือค้ำประกัน

หากผู้ว่าจ้างผิดนัดไม่ชำระเงินค่าจ้างแก่ผู้รับจ้างตามสัญญาข้อนี้ ไม่ว่างวดใดก็ตามผู้รับจ้างมีสิทธิบอกเลิกสัญญานี้ได้ และความเสียหายใด ๆ เนื่องจากการไม่ชำระค่าจ้างตามสัญญา ผู้ว่าจ้างเป็นผู้รับผิดชอบชดใช้ค่าเสียหายนั้นแก่ผู้รับจ้างด้วย

ข้อ ๕. วัสดุเครื่องมืออุปกรณ์ที่ใช้ในการงานรวมทั้งสัมภาระต่าง ๆ ที่จำเป็นให้ผู้รับจ้างเป็นผู้จัดหา ซึ่งจะต้องใช้วัสดุอุปกรณ์ตามขนาด คุณภาพ และช่างฝีมือดีดังที่แจ้งไว้ในรายละเอียดที่แนบท้ายสัญญานี้ จนแล้วเสร็จ

ข้อ ๖. การแก้ไขเปลี่ยนแปลงรูปแบบ รายการ และรายละเอียดตามสัญญาผู้ว่า
จ้างจะต้องแจ้งให้ผู้รับจ้างทราบเป็นลายลักษณ์อักษร ผู้รับจ้างมีสิทธิที่จะยอมรับ หรือไม่ยอมรับการแก้ไขเปลี่ยนแปลงก็ได้ ค่าใช้จ่ายจากการเปลี่ยนแปลงดังกล่าวผู้ว่าจ้างต้องรับผิดชอบ โดยคำนึงถึงความจำเป็นและผลเสียหายที่อาจเกิดขึ้นเนื่องจากการแก้ไขเปลี่ยนแปลงดังกล่าว

ข้อ ๗. ผู้รับจ้างสัญญาว่าจะไม่เอางานทั้งหมดหรือส่วนหนึ่งส่วนใดแห่งสัญญานี้ไปให้ผู้อื่นรับจ้างช่วงอีกทอดหนึ่ง โดยมิได้รับอนุญาตจากผู้ว่าจ้างก่อน เว้นแต่ผู้รับจ้างเห็นว่างานที่ทำไม่อาจเสร็จสิ้นตามที่กำหนดไว้ในสัญญาข้อ ๒. ผู้รับจ้างจะเอางานส่วนใดส่วนหนึ่ง แห่งสัญญาไปให้ผู้อื่นรับจ้างช่วงอีกทอดหนึ่งได้ ต่อเมื่อได้รับอนุญาตเป็นลายลักษณ์อักษรจากผู้ว่าจ้างก่อน
