การศึกษาเรื่องนี้มีวัตถุประสงค์ 1) เพื่อให้ทราบถึงแนวคิดทฤษฎีการมีส่วนร่วม การรับฟังความคิดเห็นของประชาชน 2) เพื่อศึกษากฎหมาย ระเบียบ หรือข้อบังคับต่างๆ ที่เกี่ยวกับกระบวนการและขั้นตอนการมีส่วนรวมของประชาชน และ/หรือ ผู้มีส่วนได้ส่วนเสีย ที่มีอยู่ในปัจจุบันว่ามีความครอบคลุมเพียงพอหรือไม่ 3) เพื่อศึกษากระบวนการมีส่วนร่วมของประชาชน ทั้งนี้ เพื่อนำเสนอ รูปแบบ วิธีการที่เหมาะสม ในกระบวนการมีส่วนร่วมของประชาชนในการจัดให้มีสวนสาธารณะในที่ราชพัสดุ
จากการศึกษาพบว่า การจัดให้มีสวนสาธารณะในที่ราชพัสดุ ไม่มีการพิจารณาในเรื่องความเหมาะสมของพื้นที่ หรือ รูปแบบโครงการ ตลอดจนมิได้คำนึงถึงอัตลักษณ์ วัฒนธรรมท้องถิ่น ทำให้เกิดปัญหาสวนสาธารณะไม่มีประชาชนเข้าใช้บริการ หรือมีประชาชนเข้าใช้บริการน้อยเมื่อเทียบกับสัดส่วนการลงทุน ส่งผลให้ขาดการดูแลและอาจจะเป็นแหล่งมั่วสุมหรือที่พักพิงของคนไร้บ้าน ประกอบกับไม่มีการประเมินผลความคุ้มค่า ความเหมาะสมในการจัดทำตามหลักธรรมาภิบาล ทั้งนี้ อาจเนื่องจากมาตรการตามกฎหมายที่ราชพัสดุที่มีอยู่ในปัจจุบันเป็นเพียงการกำหนดหลักเกณฑ์และวิธีการในการปกครอง ดูแล บำรุงรักษา ใช้ และจัดหาประโยชน์ในที่ราชพัสดุ ไม่ได้กำหนดหลักเกณฑ์วิธีการในการจัดการเกี่ยวกับการเพิ่มพื้นที่สีเขียวโดยตรง ตลอดจนไม่มีกรอบกฎหมายเฉพาะที่กำหนดให้ต้องเปิดโอกาสแก่ประชาชนได้เข้ามามีส่วนร่วม อาจเป็นเพราะว่า โครงการดังกล่าวมีภาพลักษณ์ในลักษณะเป็นการเพิ่มคุณภาพชีวิตให้แก่ประชาชนมิได้ก่อให้เกิดมลพิษต่อสิ่งแวดล้อมอันจะต้องจัดทำการศึกษาผลกระทบสิ่งแวดล้อม หรือขัดต่อประเภทการใช้ประโยชน์ที่ดินตามกฎหมายว่าด้วยการผังเมือง

ช่วงเวลาก่อนดำเนินโครงการ 1) จัดให้มีการเผยแพร่ข้อมูลข่าวสารโครงการอย่างเพียงพอและทั่วถึง 2) เปิดรับความคิดเห็นจากประชาชนโดยวิธี ดังต่อไปนี้ (ก) การสัมภาษณ์รายบุคคล (ข) การเปิดให้แสดงความคิดเห็นทางไปรษณีย์ ทางโทรศัพท์หรือโทรสาร ทางระบบเครือข่ายสารสนเทศ หรือทางอื่นใด (ค) การเปิดโอกาสให้ประชาชนมารับข้อมูลและแสดงความคิดเห็นต่อหน่วยงานของรัฐที่รับผิดชอบโครงการ (ง) การสนทนากลุ่มย่อย 3) รับฟังความคิดเห็นในรูปแบบของการประชุมเพื่อแลกเปลี่ยนความคิดเห็น หรือเพื่อปรึกษาหารือร่วมกัน โดยวิธี ดังต่อไปนี้ (ก) การประชาพิจารณ์ (ข) การอภิปรายสาธารณะ (ค) การแลกเปลี่ยนข้อมูลข่าวสาร (ง) การประชุมเชิงปฏิบัติการ (จ) การประชุมระดับตัวแทนของกลุ่มบุคคลที่เกี่ยวข้อง หรือมีส่วนได้เสีย 4) ให้ประชาชนได้เข้ามามีส่วนร่วมในการวางแผนการจัดสร้าง คัดเลือกสถานที่ และ/หรือ บริหารจัดการ
ช่วงเวลาดำเนินโครงการ ให้มีการแต่งตั้งประชาชนที่มีความรู้ ความสามารถ หรือบุคคลที่เป็นที่ย่อมรับของประชาชนในบริเวณที่จะจัดให้มีสวนสาธารณะร่วมเป็นกรรมการในชุด
