ในกรณีดังต่อไปนี้ ให้ถือเป็นการเลิก

(ก) หากในระยะเวลาใดๆ ก่อนวันที่ผู้จะซื้อเข้าลงทุนครั้งแรก คู่สัญญาฝ่ายใดฝ่ายหนึ่งไม่ปฏิบัติตามสัญญาฉบับนี้หรือผิดคำรับรองและรับประกันที่ให้ไว้ในสัญญาฉบับนี้ และส่งผลให้ผู้จะซื้อไม่สามารถใช้ประโยชน์ในทรัพย์สินที่จะซื้อขายได้ตามวัตถุประสงค์ของสัญญาฉบับนี้
